1996 328i convertible control unit replacement

I have been trying to get a new convertible motor control unit to work it is a genuine BMW part, I have a procedure that was sent, to initialize the unit but when I go through the procedure it does not operate. the procedure states that you hold the switch in the down position and turn the key on, in approx. 10 sec. the top cover should activate and you can let off on the switch and allow it to go through the rest of the initialization. I did that and it is inoperable. In the beginning I took it to a BMW dealer and they diagnosed the problem as the control unit is operating intermittently, that is why I bought the control unit. If I stick the old control unit back in and go through the initialization procedure it works. Anyone have suggestions or know if I am missing a step? The top is in the down position when I start the procedure.

Some of these have to be programed by the dealers software to the pacific car.
