"This is a gray area. Since I'm not giving the shop a chance to rectify the situation I don't feel I can demand a refund. Maybe I'm being to nice. I don't know. You know you pick your battles and this one has to much gray area for me. I just decided to bite the bullet and move on."

The solution is that they buy your case at reasonable market rate ($$ to get you a similar condition (before the bad machining by them) replacement case) AND refund your money for the machining. That restores you fully to your original position. They can fix the case on their own dime and sell it if they want.
