Why does this posting scream "fraud?"

Mark Henry 07-24-2010 08:05 PM

Although I understand you're pi$$ed, spamming every thread will just get you a big time out.
A bit counterproductive don't you think?

Death to MM!!!!

MMClassAction 07-24-2010 10:33 PM

Main Entry: fraud
Pronunciation: \ˈfrȯd\
Function: noun
Etymology: Middle English fraude, from Anglo-French, from Latin fraud-, fraus
Date: 14th century
1 a : deceit, trickery; specifically : intentional perversion of truth in order to induce another to part with something of value or to surrender a legal right b : an act of deceiving or misrepresenting : trick
2 a : a person who is not what he or she pretends to be : impostor; also : one who defrauds : cheat b : one that is not what it seems or is represented to be

synonyms see deception, imposture

Merriam-Webster Dictionary

Fraud is generally defined in the law as an intentional misrepresentation of material existing fact made by one person to another with knowledge of its falsity and for the purpose of inducing the other person to act, and upon which the other person relies with resulting injury or damage. Fraud may also be made by an omission or purposeful failure to state material facts, which nondisclosure makes other statements misleading.

To constitute fraud, a misrepresentation or omission must also relate to an 'existing fact', not a promise to do something in the future, unless the person who made the promise did so without any present intent to perform it or with a positive intent not to perform it. Promises to do something in the future or a mere expression of opinion cannot be the basis of a claim of fraud unless the person stating the opinion has exclusive or superior knowledge of existing facts which are inconsistent with such opinion. The false statement or omission must be material, meaning that it was significant to the decision to be made.

Sometimes, it must be shown that the plaintiff's reliance was justifiable, and that upon reasonable inquiry would not have discovered the truth of the matter. For injury or damage to be the result of fraud, it must be shown that, except for the fraud, the injury or damage would not have occurred.

To constitute fraud the misrepresentation or omission must be made knowingly and intentionally, not as a result of mistake or accident, or in negligent disregard of its truth or falsity. Also, the plaintiff must prove that the defendant intended for the plaintiff to rely upon the misrepresentation and/or omission; that the plaintiff did in fact rely upon the misrepresentation and/or omission; and that the plaintiff suffered injury or damage as a result of the fraud. Damages may include punitive damages as a punishment or public example due to the malicious nature of the fraud.

Easy Pilgrim
As much as your passion is inspiring, moderation might be advised.
Your pursuit of a class action will require diligence and a serious direction.
Your explosion on the scene will generate a comment or two but if you present a more reasonable front and stand behind your accusations with your name you may seem more serious and less like a "nutbag" with a grudge.
Good luck

I agree with Turbo, although your intentions are seamingly honourable, the way you are going about it is not a way to get many reasonable people on your side. Also, mispelling words like "bin" are not going to help you get any credibility. Not trying to derail your ideas but maybe cool down for a day or two and then come back and I'm sure those who have been taken by these guys will come forward.

IMO, you might also want to realize that the way you are screaming looks as if your in for the class action suit either as a fraud or as somebody trying to get the "plaintif incentive". I'm not saying you are just letting you know that's how it sounds to my ears at least.

I agree, with the others and was the one that suggested you stop spamming all the threads and start you own.

That said, you likely have a good case. Those folks running MM deserve such a suit, no doubt about it. But, you need to act above and beyond the character they display in order to get folks who were wronged by them to put their hands up.

There are many on this forum, and many on other forums, that have been screwed by MM. Might I suggest you do a search and PM those that have already expressed publicly that they have been screwed? You will likely find some that are willing to sign on.

You need to also state what the goal of the suit may be.... are you looking for old style retrobution, some monetary compensation or to just put them out of business????

A class action could be difficult as each member of the class would have a different story and circumstance making dividing up any reward very difficult.

I honor your intentions and think that, quite frankly, it is about time someone who got screwed stopped complaining on the internet and started doing something. If that person is you, you have my highest respect.

If you procede in an ethical and professional manner I would be happy to help out in any way I can.

Cheers

I would suggest talking with a good class action lawyer..file suit..and have the firm post notice of a CA in the appropriate channels. That is the way it usually works. Once the firm has enough response from people to justify a "class", the court is petitioned to approve.

If there is not enough people to form a class action..you can still sue as a individual. You can get some big money if you can prove the MM operation was intentionally misrepresenting or defrauding their customers. A good lawyer can dig around with former employees..emails..documents, depositions and the like.

A broadcast on a forum like this may make you feel better and you will harvest a few fellow victims. It won't help start a CA..you need to take the first step and get a good attorney.

Good luck.

One thing that brings up a flag - all the misspelling in your posts. Constant misspelling and incorrect grammar also screams something.

Be diligent - be correct - be clear. I own my own business and if I received a letter like this, I would probably ignore it. These kind of errors that I noted discounts the intent of the post.

Although the proposed action has not gone forward this post reminds people that MM is still in business and there is no indication that they have changed their evil ways.
This post and posts like it, reinforce the notion that MM may be better left a punch line to a bad joke, than on a list of possible service providers.

Porsche people looking out for Porsche people is one of the best uses of a forum like this.
