my convertible top broke?

hello, long time first time. my name is Jorge. I bought my girl friend a 2005 mini cooper s convertible. she loves it. we've owned the car for almost two years now. its been great except a few issues. most recently, the convertible top doesn't close correctly. I've researched the issue but I've found nothing like mine. I know there's a cable issue where the sunroof part stops working but this isn't that (well I doubt it anyways).

my issue is that the top opens but the passenger side lags behind the drivers side. so when it opens the passenger side stays elevated in comparison to the drivers side. when closing the top, since the passenger side lags, the top doesn't align when closing. meaning the "spikes" miss their "hole receptor thingy." the top doesn't close and ends to the right of where its supposed to close. now, when the top is half way opened and you try pushing the drivers side back or forward there's immediate resistance, do the same on the passenger side and the top allows movement back and forth. its like either there's an issue with the hydraulics or something. does anyone have an idea of what I can do? thanks for any help

Ok. I'm gonna take it to BMW. Hopefully they don't charge me too much to tell me what's wrong. I'll let you guys know how it goes for the next guy who has this issue. Thanks anyways.
