I just purchased a 2004 mini cooper base model with 33000 miles on it. I believe it is the CVT because of the paddles on the steering wheel. It seems to hesitate slightly in first gear. Is this a sign the transmission is due for fluid and filter change. Thanks.

Hesitation is not a sign of fluid wearing. Unless by hesitation you mean slip, are the RPMs rising but the vehicle is stationary?
