A mom has filed a $1.1 million lawsuit against the owner of a pit bull and Alaska Airlines after the animal allegedly mauled her 5-year-old’s face at the Portland International Airport.

The lawsuit, filed Monday in Multnomah County by Mirna Gonzalez on behalf of her daughter, Gabriela Gonzalez, claims Michelle Brannan, the dog’s owner, should have known her animal had “vicious propensities” and that Alaska Airlines allowed her to bring a dangerous dog into the gate waiting area without being confined or trained.

According to the suit, the incident took place Dec. 18, 2017, while Gabriella Gonzalez was waiting at Gate C7 with her family for a flight to Texas at the Portland hub.

Gabriella, then aged 5, was waiting at the gate when Brannan entered the area with her pit bull, which was not kept in a crate, kennel or other secure container, the lawsuit claims. The child allegedly gained permission from Brannan to pet the dog. While she was petting the animal, it bit her, causing serious injuries.

“As a result of the incident, Gabriella Gonzalez suffered injury to the muscles, tendons, bones, nerves and soft tissue of her face, eye, eyelid, tear duct and lip, as well as emotional trauma,” the lawsuit reads, noting that Gabriella was left with permanent scarring and “required surgery to repair complex facial lacerations and a damaged tear duct, and has incurred medical expenses and will incur future medical expenses.”

Brannan had told the airline the pit bull was an emotional support animal and went through the ticketing process at Alaska Airlines.

Alaska Airlines does not require emotional support animals to be in crates, stating on its website that pets must be at least leashed and under control of the owner. However, the Port of Portland felt Brannan’s dog should have been in a crate or kennel and cited her for failing to do so before the alleged attack.

Alaska Airlines declined comment to Fox News, stating “it would be inappropriate" for them to comment about the case. They have yet to receive the lawsuit.

Kama Simonds, a spokeswoman for the Port of Portland, said in an email to the Oregonian that the Port may ask a traveler if the dog is a trained service animal and can ask what service the dog provides.

“The traveler need only answer those questions and we’re required to accept the answer,” she said.

Chad Stavley, the Gonzalez’ attorney, told Oregon Live Brannan reportedly was carrying what appeared to be a form letter from her therapist, though it was not specific.

“It didn’t say what kind of animal,” Stavley said. “It was just a generic ‘animal.’”

The suit claims Brannan is liable for all damages incurred during the incident and is seeking $100,000 for past and future medical costs and $1 million for the child’s pain and suffering.

It was not immediately clear what happened to the dog after the incident.

This is what happens when we start accepting "emotional support animals" into places that animals don't belong. Every other granny out there claims poopsy is an emotional support. :rolleyes:

A Lab would not do that, in my experience, pit bulls might...in my experience.

I have never heard of an emotional support animal. A seeing eye dog, yes.

I can see where the little girl may have gotten into the dogs "space" and triggered it to freak out and take action.

The dog should have been left at home and tended to while owner was on the trip.

Now I'm waiting for all the pitbull supporters to come out an say its not the dog's fault. You can't have a lion running around, and you shouldn't be able to have a pitbull. I say kill them all and wipe out the breed and stop this BS now !

Did you hear about the emotional support peacock that some lady tried to bring on a plane? (not kidding).

As some of you know I work at a museum and we have been told we cannot challenge anyone that shows up at our door and claims their dog is a emotional support dog (we have an exhibit on dogs coming next month, and yes we are advertising "LEAVE YOUR PETS AT HOME!")

And now I have to go hug my emotional support Boa constrictor.

Yeah that’s a crock of BS. Every dog provides emotional support, that’s why people love them.

It never ceases to amaze me how soft we Americans are becoming. An emotional support dog, really? What ever happened to saying NO dogs allowed. Take a stuffed animal and suck your thumb if need emotional support. If want to take your dog ona trip drive your car. Flying over Xmas I actually stepped in a pile of dog crap in the airport terminal of all places. On another note, I’m shocked the mother allowed the girl to pet a pit bull, what was she thinking? I tell my youngsters to never get near them or think about petting them. I love dogs, but they don’t belong in passenger plane compartments or in the malls. Walk them in the park and your neighborhood.

I think the $100,000 plus the million should handle this nicely. How do I got on the jury?

I'm perfectly fine with support dogs. I know that there are support animals that can tell an epileptic are about to have a seizure and warn the person so they can get to a safe place.

You can't tell me that there aren't valid emotional support animals.

But, I think they should be trained and treated like a regular support animal for the blind or otherwise handicapped or any other sort of support dog.

I met a guy in the grocery store one day that had a support animal. I feel fairly certain that the guy probably needed the dog and the dog acted, to me, like a seeing-eye dog. Completely uninterested in anything going on around him other than staying with his owner.

What I do think is crap are the people that are abusing the system, and I believe that the woman in the original post is one of them. Basically, bringing a regular old pet along because you're happier when you can bring your pet is BS. I'd like to see a judgement against the lady with the dog (no money will ever come from it, but I'd like it to happen), and a payout from the airline or airport.

I'm not a fan of BS litigation, but for this sort of thing, I don't think anything is going to change until it starts costing people money and/or ending up in court.

There's an old couple that shows up at wallyworld with an "emotional support dog" chihuahua. The problem is that the dog starts crying if it can't see the woman. This is a case of poopsie loving his mommy and she will lie to everyone to be sure poopsie woopsie is OK. :mad:
I approached the store manager and they said they must accept whatever the customer claims.
The victim is the child. She trusted the owner who said it was OK to approach a lethal animal claiming it to be emotional support. I have to really try hard not to wish the animal turns on its owner as karma for lying to everyone. I know its not the right thing to want but...

No well trained dog would do that.

Our dog has been trained from an early age to be very tolerant. You can put your face right in her food bowl when eating and she will just back off and wait for you to move.

Its a damned shame when people don't train them well and they have to suffer this fate.

yes I hate the kids in airports, on leashes............parents trying to teach them to heal, sit, stay.....failure, and denial of the parental units.... maybe you've seen the leashed on area in your local shopping mall. You see these ankle biting animals everywhere.



Maybe it was the freak show family on a 17 hours airplane flight that convinced me.

Sounds like you are thinking of actual service animals. There big difference between legitimate service animals, and the current trend of "emotional support" animals with inadequate (or no) training.

I have a patient with a pit bull that tells her if her blood sugar is too low. The emotional support thing is also legit, in a minority of cases.

Thing is, legit ones are well trained, so not this case.
