No eviction due to virus ?

WTF, our dumb ass Mayor say there's going to be no eviction for tenants due to Corona and the slow down in the economy. He will make more noise about commercial in the coming days but nothing for building owners or owners who has a mortgage. We take it on our shorts. I can see it now how some will completely take advantage of this. It can go on for 6 months, I hear.

Tobra 03-16-2020 06:38 PM

How exactly can this be enforced?

Bill Douglas 03-16-2020 06:50 PM

I'd been thinking about this a bit over the last few weeks. No job means no money to pay rent. I guess I'll just have to go hungry, but I'm not throwing anyone out of their home. No legislation in this country but I feel it's my moral obligation to look after my tenants and worry about the details (rent owing) at a later stage.

look 171 03-16-2020 06:50 PM

Can't. they can all claim hardship due to virus and they are off the hook. Its a free for all and he's giving it away and we are stuck with the bill

Yeah, but in the mean time, your bank is up your ass with payments. Small residential units, they might be able to swing it for a couple of months, but some of the commercial rent or mortgage can be up into the 30-50,000 dollar range, per month. Lets say you own a ten unit apt and the rent is 1500 a pop. That's 15,000 a month you must carry or lost without any proof that they can't pay it. Its so new that no one know what's going to happen or if it will even go anywhere but simply proposing this is BS.

Bill Douglas 03-16-2020 07:11 PM

I'm an old man and freehold. So don't owe anyone anything.

I think the banks have been told to be friendly to people. Also the tax department has too. The official cash rate is quarter of a percent, so the banks have plenty of margin to still make their profits.

RWebb 03-16-2020 07:12 PM

Does this apply to all landlords, or just those with more than 8, 16 etc. number of units?

Webb, so far its an LA thing. I think it will spread like wildfire, hope not. Another way for them to screw owners.

Our tax dept, the IRS, friendly? HAHAHAHAHAHA

Bill Douglas 03-16-2020 07:43 PM

We have had some bizarre tenancy law changes here too. Lots of landlords are giving up and selling the houses. Which means less houses available for people to rent - duh.

I've only got really good people in good houses. People focused on their lives and their careers, not on how to rip off the landlord. So I'm lucky.

Tax department friendly - it sounds like a contradiction in itself LOL

Our government is talking about extending the tax deadline out from April 15 to some later date, in order to let people hold their $$ a little longer at least.

Saw this today, real sign in building elevator:

I don't see how a local mayor can legislate anything, including zoning laws, let alone Landlord Tenant laws, which are legislated by the state.

McLovin 03-16-2020 09:30 PM

Haha, Constitution? What’s that?
This is just forced, privately funded welfare.
I’m sure property taxes are still due on time.
If the government wants to provide free or deferred rent, why not use taxpayer dollars to pay people’s rent (or loan to people to pay their rent)?
If this is a government or societal obligation, shouldn’t the government, or ALL of society, kick in?
Such bizarre logic.

Please don’t give misleading info. No one can just claim hardship. One has to prove it with documentation.

As far as enforcing. The courts have been instructed not to take new cases and suspend existing ones.

If courts are instructed not to take new cases, why would a tenant who simply doesn’t want to pay bother showing any “documentation?”

Just a simple “Hey man, sorry about the no rent, corona virus lol” will do. (And lots will do it, see elevator sign above).

McLovin 03-16-2020 09:49 PM

And suspend existing cases?
What does corona virus have to do with cases filed 30! or 60 days ago? Those tenants’ failure to pay had nothing to do with any virus.
This is craziness.
The government is scarier and going to do more long term damage than the virus.

McLovin 03-16-2020 09:50 PM

Although I think a lot are getting the revolution they wanted.

(But contrary to the old saying, this revolution most definitely WILL be televised).

I’m on my phone and don’t want to deal with copy and paste... Here’s a link on the subject.

rusnak.... Newsom gave power to the cities temporarily.

McLovin 03-16-2020 09:58 PM

Exactly. A tenant doesn’t have to show jack. He can just laugh in the landord’s face.
Because what’s the landlord gonna do about it? All of the landlord’s enforcement rights have been stripped away by one guy overnight.
Politicians in places like LA and SF know exactly what they’re doing.

McLovin 03-16-2020 10:01 PM

Classic fascism. Disregard the Constitution, seize and abuse power, deprive rights and advance your own personal political agenda under the cloak of “emergency declaration” and “public benefit.”

This truly is insanity. Not the virus nearly as much as the government and the mass panic and hysteria.

We are seeing the biggest breakdown of our political system in our history.

I don’t follow. The tenant still needs to prove with documentation to the landlord, as per the article.

Pretty clear to me what is being said:
“ “I hereby order that no landlord shall evict a residential tenant in the City of Los Angeles during this local emergency period if the tenant is able to show an inability to pay rent due to circumstances related to the COVID-19 pandemic,”Garcetti said in his order. “These circumstances include loss of income due to a COVID-19 related workplace closure, child care expenditures due to school closures, health care expenses related to being ill with COVID-19 or caring for a member of the tenant’s household who is ill with COVID-19, or reasonable expenditures that stem from government-ordered emergency measures.”

“Nothing in this subsection shall be construed to mean that the tenant will not still be obligated to pay lawfully charged rent. Tenants will have up to six months following the expiration of the local emergency period to repay any back due rent. Tenants may use the protections afforded in this subsection as an affirmative defense in an unlawful detainer action. This subsection shall remain in effect during the pendency of the local emergency period,” it continued.”

The masses don't want logic, McLovin. They want drama. And boy does this deliver.

"Everyone needs to be tested." - but why, if there is no cure? Oh right, so it can be tracked. But why does it need to be tracked? Well, let's shut down the economy and get some numbers.

The 'logic' seems to be . .. uhm... wait; I almost had it. Nope.

Some fairly massive changes that took effect at the beginning of the year WRT rental property here

I probably know 20 or 30 people that were prompted to divest themselves of their rental properties due to the anti-landlord bias of the laws here. Can't imagine that making the rental market improve.

If they go through with this, how is it much different from just straight up seizing the property?

McLovin 03-16-2020 10:09 PM

I know you don’t follow. Unfortunately probably 95% of the citizenry doesn’t either.

I’ve mostly tried to stay out of these discussions.

But the hysteria and complete govt insanity is frightening.

These local govts seizing power. Rights being completely thrown out the window. Congress about to pass massive legislation with most of them never readlng it and no one knowing what’s in it. People like Romney saying to cut every adult a check for $1000. The list goes on and on.

And everyone going along no questions asked.

It’s shocking.

It’s not meant to be an insult, please accept my very sincere apology.

But again, if the landlord is prohibited by law from filing an eviction lawsuit, any “documentation” requirement is meaningless window dressing mainly designed to fool the public.

Because without the ability to file an eviction action, a tenant can choose to not pay rent, for any reason or no reason at all, and there’s NOTHING a landlord can do about it. ZERO.

The elevator sign shows what many tenants are already thinking.

island911 03-16-2020 10:32 PM

it is shocking.

I thought that most people knew to not bring colds and flu to the co-morbid elderly. I know that I've avoided seeing my almost 80y/o mother for the last week because I had a sore throat. But apparently it's not enough for some to let people take their own precautions and chances. It's not fair(?)to isolate the elderly and let the young productive people do just that.

And of course You can cover their rent due to wages lost from being forced out of gainful employment, right?

Land of the free, Home of the brave - or - Land of the Freaked, Home of the stay.

McLovin 03-16-2020 10:42 PM

Anyways, slodave I don’t mean to insult anyone (and certainly not you!), so I hope you accept my apology and I’m out too! :)

Bill Douglas 03-16-2020 10:48 PM

If people can't pay the rent then they probably can't pay for food at the supermarkets. And the supermarkets are in a better position to carry them than landlords are. Maybe the state governor should tell supermarkets free booze and ciggies for anyone who can't pay.

rusnak 03-16-2020 10:58 PM

Okayyyy...so a County judge is going to take orders from a wack-a-do mayor?

I don't think so.

look 171 03-16-2020 11:00 PM

Nothing is set in stone but I bet all the proof needed is the difference in the paycheck. For example, if a worker's pay has been reduced due to hours being cut, I bet they will qualify for not having to pay rent. In the mean time, who the hell is going to carry the landlord? My friend's worry about commercial. If their business numbers falls, they qualify for not having to pay. That number can be fudged easily for business owners especially food related businesses

People who don't pay rent or don't pay their mortgage will still lose their homes. So the order does nothing.

It is being considered or passed in PDX, not here yet.

laws re landlords are super stringent here already, but there are a lot of exceptions for renting out a room, owning a duplex and other, smaller landlords

I got out of it years ago. But if you back off from your personal position and imagine you are a renter - say a 24 yr old working 2-3 part time jobs in food service, barista, etc. and you lose your job due to the disease, then lose a place to live...

you can see how bad it would be for those people (and I got to know a few by going to a coffee shop every day)

you can also see how bad it would for society to have a huge surge of homeless all of a sudden

I'd get on the horn to my repr. and ask about how small landlords will be compensated for their losses... mention big banks too.

Im in NY and for the past 2 days we have received notices/directives from courts advising what types of cases can be filed. As of yesterday all evictions are suspended statewide. Soon there will be a moratorium on foreclosures. Same thing happened after hurricane Sandy. The reasons for this are many and should be obvious. For one, If everyone loses their income and then gets evicted at the same time, none of you will like what happens next

I don’t like it because I am about to lose my income over these filing suspensions but I do understand it and support it. I much rather not have thousands and thousands of hungry homeless angry people walking around my neighborhood

In other words, one reason is to protect the public health. Another is to not over burden the court system. Another reason is to let some time pass to see if people rebound and work out an arrangement with the landlord/lender etc......

fastfredracing 03-17-2020 12:45 PM

Figures. Wife and I killed ourselves last year taking over the rental house biz. We got all 5 rented, and are currently collecting full rents on all of them . Just last month, we paid all the back owed water bills, and rehab costs, and for the first time in 15 years of this business , we were poised to actually make money .
Just penned out our first big tax payment, and insurance payments, and there is a little bit of money in the account .
There goes that .....all to hell.
It is my job as a good human to try to keep a roof over these people for a while though . I have already thought this out in my head . I am planning on forgiving some rents for a few months if I have to . We are all gonna have to make some sacrifices here . Good thing, they are all paid off .
I have one section 8 unit, glad I diversified a little bit , that one will still pay . I have one big house where the tenant manages an eatery , so I am sure I'm not collecting there.
I have one healthcare worker, and one government worker , kind of expecting( hoping ) them to keep paying .
At some point, though, enough will be enough though.
