Medical Family Leave Act Question.
I talked today to someone that just got sick and had to go to the hospital and was admitted.
Work called her and mentioned the FMLA and when she told me that I seem to remember why you don't wan't to take it because of your retirement. Seem to remember maybe here on Pelican someone stating that you should take your sick day's instead. Will the brain trust please chime in. Thanks in advance RT. |

FMLA for me was that I could take time off without advanced approval and was guaranteed a job when I came back. It didn't pay me but I had plenty of Paid Time Off to use. I don't know if it is different by state. Check with H.R.

I'm not in HR.
But I believe FMLA has nothing to do with retirement. I do believe it allows extended time away due to qualifying situations. My understsnding is up to 12 weeks and your job is held for you. |

Perhaps company policy requires them to use up vacation before FMLA? And I agree I don’t this this has anything related to retirement.

Perhaps the issue is that there are no retirement contributions from an employer toward a person's account while they employee is on FMLA?

Companies by Federal law have to make the employee aware and they have a choice of using that or not. Basically it is 'protection' of the employee's position/ salary while away. It does not however, require the company to pay the employee while they are out. So it is LWOP but they cannot fire or eliminate that person. So that employee can choose to use whatever paid leave they have accumulated.
While FMLA does require the employer to do this, does not mean they cannot fire or furlough them once back at work where they may be deemed more of a liability than an asset. I've seen this happen on more than one occasion.
