Spoon change of ownership
 

OK, so my wife's brother passed away and is a resident of CA. The spoons will all go to my wife and we are WI residents. I didn't think we needed to get a FFL involved, but her stepdad says we need to transfer out of state via FFL. What would ya'll do?

Suspect only the case if you want to send it over , not if you go over there and collect it yourself.
CA doesn't require papers or background check amongst relatives. in state.

So if you go there
do paperless transfer

and then bring it back home you wouldn't need an FFL as per federal law 18 USC § 926A, every U.S. citizen may legally transport firearms across state lines if you are legally allowed to have it in both states.

But somebody local might have better intel on that (I just know cause i used to be in guns in Europe and had eye on various countries laws as I also launched an action against EU proposing new stricter legislation)

Are you going to Cali to get them or are they going to be sent to you?

If you're going to get them, I'd get them and leave the state.

If you're going to have them sent, then you're going to need an FFL.

If you are having them sent to you, FFL.

Harbor Freight has decent cases that would make it thru TSA that are less than half cost of Pelican.

I really screwed up last summer and was checking my CCW. My case, not HF or Pelican, wasn't up to snuff. It was not a pleasant experience with a TSA douche. Luckily called a family member that had just dropped me off at airport and they retrieved my piece. I collected it a few weeks later when I came back.

Any interstate transfer needs to go via FFL.

This includes you flying to Ca and picking up in person. This is federal law, not one of California's crazy restrictions.

If I was coming back with a U-haul full of stuff, they'd be in the U-haul full of stuff. I wouldn't be worried about it. They wouldn't be on top at the back. They would be buried. You'd have to unload the whole thing to get to them.

You mean all those spoons that were lost in the boating accident? It is a real same to hear about the lost spoons in boating accidents.

Boating accidents are the best kind of accidents, especially on dry land.

I ordered a lockable rifle case and padlocks on Amazon, had them delivered to my dad, and then I checked the rifle when flying home. Easy peasy. But it was only one gun. I don't think I've ever flown with multiples at the same time.

I have. Two pistols, both owned by my Father: His Colt 1911 he fought with and a Colt Navy Officers .38 revolver that was my Mom's fathers. Two cases, each commercial flight worthy with the right locks, in checked baggage.

Zero issues, direct flight from SFO to Dulles.

I've heard that if you're flying, the best way to make sure that your luggage isn't lost is to have a gun in the luggage.

Never flown out of CA with a gun before, but have flown into CA that way. Scariest one was checking a SIG P220 at Chicago Midway about 25 yrs ago. I'm pretty sure I was bending the law by even having it with me in IL, much less in the airport, without a FOID. But the ticketing counter guy had to read the instructions for checking it and asked me to lock the slide back for him. Lots of people were staring at that.

I'd probably not try on the left coast, IL, NY, or NJ. I'm sure there's a couple others to avoid as well.

Oh hell, there was a guy arrested in NJ a few yrs ago who had an unplanned layover in Newark due to mechanical issues. He had checked a gun to his final destination and had to collect his bags in Newark, got arrested and gun was confiscated. It's insane.

I really had no choice. My Dad was dying and lived in Fairfield, California. He wanted the guns to go to me and my son.

I found a gun store Vacaville that told me exactly what to do. I read all the regs as well...especially getting to the airport!

It also helped that at the time I was a United Beryllium member and, based on the advice of the gun store owner, called United in advance and let them know. They were great.

Pretty sure her brother "transferred" them upon death. You own them I've flown dozens of times through airports.. As long as you have no ammo in the same lockable case you'll be ok. Wouldn't hurt to call the airline first in these insane times. As long as they aren't handguns leave the gov. out of it.
