(do I like it) The criminal gets his choice. As a citizen, I’d rather see someone vaccinated vs the community service. I look at it as a win-win. If the criminal gets COVID, he might come out way ahead.

My counsel says there is no legal problem setting that as an option for a sentence.

He was a judge, a Texas legislator, and is me own pops. Let it go.

I disagree, personally.

pavulon 09-14-2021 05:58 PM

What are the odds that the person at issue has any health insurance? If infected and hospitalized, play that tape forward. How much is 120 hours of community service from that person worth?

The person at issue should count himself as fortunate to be given the freedom to choose.

john70t 09-14-2021 06:04 PM

I believe there should be a duty to delegate justice as fit. (or whatever the legal term for that is)

Absent of extenuating circumstances, the spectrum of punishment must fit the crime to the applied charges, evidence provided, and other factors of bringing a good citizens back to society at the end.

Keep the criminals healthy!

Good thing some cities have "safe injection sites" to help keep the druggies safe for their next dose of mind-numbing societal contributions.

You clearly don't understand the concept of criminal sentencing.

So if the criminal was a “responsible” criminal and already got the vaccine, does he automatically get the community service waived?
Or is that sweet deal only available to irresponsible unvaccinated criminals?

Legally- this may be wrong. I’ve not been to law school.

Morally - I get it and support this.

"I believe vaccines are part of our social contract."- I beleieve if we have a "social contract" it is to obey the law. Not sure this applies Yet.

Ahh you are morally superior.

island911 09-15-2021 07:32 AM

^LWJ gives criminality a pass. (whistles on by that) says "free vax" is part of our social contract.

Yeah, if no option to report anonymously I would not even consider mentioning it.

Nail that sticks up gets hammered down.

There is nothing about this story that sounds good to me.

well no.. it's "Do this and then you get a discount off your punishment"

The punishment is the baseline.

I'm all for vaccinating, but I think it's BS to give em huge discounts like that.
I'de go along for 8 hours discount.. like 1 day.. and arguably that's the day they go get the vaccination so it's tit for tat

Something like 80% of criminal cases in the county have court appointed attorneys. Most folks I know take appointed work to supplement their practice.

This rather puts people in strange place because you don't want to bite the hand that feeds...

The appointments are managed in a central clerks office but there is still some judicial influence.

Interesting point that I had not considered.

Raises the specter of double standard

They have the "right" intentions though, so it slides.

The latitude of the judge is given by those whom he serves, even criminals. If he/she sees the punishment fits, for the greater good of the community, it's perfectly fine with me. I should get jabbed, and I hope it's not ordered by a judge.

If the community has an issue, they will vote them out, or vote out whom ever appointed them.

Zeke, the point to criminal punishment is coercion.

clearly not since the waiver is to get them to do something
if it's already done, there's nothing to barter.

Bill Douglas 09-16-2021 02:43 PM

The next lawyer defending someone on a similar charge can say "In the case of State against Mr. ***, the outcome was..." And let my guy off completely if he'll get a jab.

Exactly why this is a problem.
