Renter’s dog

Anyone know if a renter’s dog bites someone in front of the house or walking in the neighborhood, could owner of rental be sued.
I have a house in Charleston SC,
someone wants to rent but they have a dog. Mgmt company said renter will need renters insurance and it can’t be some dog from some list (pit, rottie, …).
Thoughts?

Probably not, unless the landlord is on notice that the dog has dangerous propensities, but the SC Supreme Court has been opening the door to more landlord liability. https://rjrlaw.com/sc-landlord-liability-for-dogbites/?doing_wp_cron=1656615015.3881790637969970703125

But renter's insurance isn't expensive. Make them buy it and add you as an additional insured, and make sure your landlord's commercial policy covers you if there's a hickup on the renter's policy.

I would expect there to be a requirement for a renter to have renter's ins. We rented an apt for 7 years. We had to show proof of renters ins every year. If we didn't, the apt would get us their ins and tack it onto our monthly rent.

I have no knowledge, but I would expect the renter's ins to cover that sort of thing. But I suspect whether the landlord could be targeted would depend upon the laws of the state.

Kind of like the recent issue where the guy that worked for the dealer ran over a mechanic, so the owner of the car is being sued because the dealership can't be directly sued.

That sounds reasonable, and I think MRM frequently stays at Holiday Inn.

I’ll call my insurance guy. It looks like I do but there is so much jargon, I’m not sure.
Same with reading an article, seems typically no but sometime yes.
Yeah the car thing has me questioning everything.

We charge extra for pets, make sure the renters have insurance, and we have insurance. In the worst case situation the insurance will cover your legal fees should someone try to come after you. And in cases where someone is bitten, especially a kid, they will go after everyone they can. Insurance is cheap.... well insurance. You can easily end up massively out of pocket fighting something even if you are in the right otherwise.

I always had "no pets" in my leases.... but allowed them . Had a longtime LEO tennant (atty wife) who had Blue Heelers.... being a dawg person, they loved me too... but they would (and did) bite on occasion. One bit the LEO's partner, and the other bit my cop tennant. But these were nips ... not viscious attacks. I've been in the middle of, and broken up my share of PB dog fights... btdt too many times. I actually asked here on PPOT about my personal liability regarding the Heelers... MRM pointed out that a "nip/bite" is not the same as a viscious dog attack .... other dog or human. I accepted the risks with those two Heelers. I would NOT accept the risks with a PB, Rottie, or Chow for example.... but that's just me. Good luck!

Just know that there is a short list of dog breeds; ID'd as dangerous - that no insurance will cover

Listen to MRM.

Also, if you are concerned, have the Tenant carry limits that are meaningful. Lots of renter's insurance policies have a limit of $100,000. If a kid was disfigured? That amount would be woefully small.

I let my tenants have dogs, "nice" dogs only.

The great thing about it is hardly any other landlords around here will have them so they are not likely to move anytime.
