A. You don't know the build was not intentional......

There would be no way to transfer title to the purchaser, if on the wrong lot. No way it was intentional.

So as I thought. The developer's should have dug deeper in their pockets, but with an ask at 1.3 million, she is a pig looking for a windfall.

She's only entitled to her loss, fair market value of the lot.

It will be interesting to see how the courts sort this out.

The judge denied, however, Reynolds' motion that the lot be restored to its previous condition in terms of flora and fauna.
.........
Reynolds is the owner of the lot, though, per Hawaii Tax Auctions, the title is not clear and the auction property can be claimed by the estate of the previous owner in the future. Reynolds purchased the lot in 2018 for $22,000.
She effed up, property not getting restored. Should have kept the house, and sold it for a profit.

Developer effed up also, should have tracked down the estate and bought the lot.

Edit: She doesn't even have clear title to the lot. She can't sell. Should have taken the developer's offer.

But to complicate matters, Reynolds' lot does not have a clear title, as her property was purchased at a tax auction. That means the estate of the former owner could technically lay claim to the lot, so a mortgage is an impossibility when it comes to trying to sell off the lot and house that sits upon it together.

Wow, you ask a grandma and don't confirm the plat or the property lines? I don't think that would pass for due diligence. They should add a multiplier for damages for the as a mitigating circumstance.

Thanks for leaving grandma out of it.

In that area, grandma is probably high.
