New California Classic car smog exemption bill.

This new California Classic car smog exemption bill (SB712) proposes to exempt collector cars that are at least 35 model years old from the state's Smog Check program.
It basically changes the set 1976 and newer year to a rolling 35 years old, provided the vehicle has collector car insurance.

This has been tried unsuccessfully a few times, but there's renewed pressure on CARB given the current administration. There's also another bill called the Transportation Freedom Act that basically aims to strip California of setting its own stricter emission standards than those of the Federal government. This will have a huge positive ripple effect nationwide.

The federal government can set a standard, states are allowed to set the standard higher.

It’s a State’s rights issue. The rolling exemption seems reasonable, Schwarzenegger should have never stopped it . . . but like Tobra, I’m skeptical the new bill will pass.

LOL! Moreno doesn't know what's on used car lots in Ohio. He doesn't know what's going on in Ohio at all. He hasn't been back for a town hall or a meeting with voters since he went to Washington. You can't call him, he doesn't respond to emails. I think he just went to Washington to get away from Ohioans.

Its not that cut and dry. California clean air laws operate under EPA waivers which are granted by the Federal government. In other words CA cant arbitrarily create environmental laws without going through the EPA first. In this case, what's being considered it clawing back the EPA waiver which allows CA to set its own emission standards.

A very recent example is the Advanced Clean Fleets (ACF) act, which was a bill proposing all trucks operating in the state of Ca would need to be zero emission by 2035. CARB tried to push this with everything they had but there was simply too much pushback, from organizations like the California Trucking Association. CARB thought they had this in the bag, even sending out tons of informationals to trucking companies throughout the state, but was basically slapped down by the EPA. No waiver, ACF is dead.

If CARB’s authority is removed, automakers would only need to design cars for one federal standard instead of making separate versions. CARB-compliant parts (like catalytic converters) are much more expensive than non-CARB versions. S.711 could reduce the cost of manufacturing, widen aftermarket options, increase competition, and lower repair costs, making both vehicles and parts more affordable. The auto repair and custom car industry make up over 750 billion dollars combined, so there is incentive to consider this given the current administration.

I really hope this bill moves forward. CARB rules are just plain silly for cars that are driven only occasionally (or not at all). I also have to wonder how many old Porsche 911 cars it takes to equal the pollutants put out by one ill-maintained tractor-trailer, or other types of "legal" air polluters.

Not to mention that I don't know of any other state that requires California-level emission testing on older cars registered and insured as collector/classic cars.

This makes a lot of sense. Too bad it took so long. In Ohio we are still the DMV to stop taxing plug in hybrids the same as PEVs. We have to pay gas tax plus the EV tax. It just ain't fair I tell ya.

A few quick updates:

The bill has been officially renamed Leno's Law and no longer requires collector car insurance. It effectively replaces the fixed 1976 cutoff with a rolling 35-year exemption for biennial smog checks. It also eliminates any smog requirement upon the sale of a vehicle 35 years or older.

With Jay Leno’s backing, the bills gaining lots of attention. SEMA is also strongly supporting it and its currently backed by 20 Senators. Looks like it has some momentum this time around.

Twenty senators - I hope this means it will find its way to other states. Colorado emissions (though not the whole state) are just as rigorous as California.
