Who's at fault?

One spouse pulls a car out of the garage, stops just outside and puts down a "box of stuff".......then runs inside the house to get something.....

The other spouse gets in the other car does not look behind the car before starting up. Entry by this spouse to the garage is from the inside the house not outside the garage door, and backs out squashing the "box of stuff".....

Who is at fault?

I will tell you who "I" was later..... to be on topic, it involves an SUV and my SC cabriolet.....

masraum 02-08-2004 09:35 AM

Hmm, that's a tough one, but I would go with the person who put the box down being at fault. Yes, I guess ideally the person should have looked behind the car before they backed out, but the one with the box should have thought about where they were putting the box and eliminated the possibility, but hey, hind sight IS 20/20, everyone makes silly mistakes from time to time.

Oh, and my guess is you shouldn't have put the box behind the SUV. ;)

John Velasco 02-08-2004 09:36 AM

Just say “Yeas Dear” and apologies!

fig911 02-08-2004 09:37 AM

which ever spouse you are is probably the one at fault...;)

No really, I don't think you should put a box of "stuff" down behind a car when it is not usual for for the person to see behind the car (like in your example, when they come from the house).

Larry Harris 02-08-2004 09:42 AM

Depends on what the box of "stuff" was! But as John so aptly put, "just say yes dear, I'm really stupid". I should have known thru my extra sensory powers that you put the box in the driveway.

surflvr911sc 02-08-2004 09:46 AM

The real question here is, what was the "stuff" in the box?

Joe Bob 02-08-2004 09:47 AM

OK....I guees I'm the *********.....but what if you factor in the fact that this is first time "I" put something behind the SUV and my lovely spouse has backed over other (fourtunatley) inanimate objects in the past?

Another car and a suitcase for example.....

BTW, MY box of stuff contained liquid polishing compound, wax and touch up paint....the polishing compound was the only thing that got run over and it squirted all over my freshly waxed and polished car....not to mention white compund on my BLACK convertible top..... just glad the paint didn't get crushed.

surflvr911sc 02-08-2004 09:49 AM

At least she didn't back over the cab :p

surflvr911sc 02-08-2004 09:50 AM

and you should have known that you would be the a-hole here. :D

Kevin Stewart 02-08-2004 10:04 AM

Doesnt really matter, ***** happens, Kevin

vash 02-08-2004 10:11 AM

NO WAY! the person driving the car is ultimately responsible. anything can be in the way, even stuff that moves under their own power. cats, kids, stuff like that. you always have to make a pass around the car to make sure. way better safe than sorry. so i vote against the spouse driving. my humble opinion, lucky it was only a box.

Next she's gonna complain about the baseball bat wedged in the banister at the top of the stairs:D

Mark Wilson 02-08-2004 10:55 AM

You are a man....therefore you are wrong.

CRH911S 02-08-2004 11:06 AM

The SUV would have cleared the box. So the idiot in the SC crushed the box and is at fault. FWIW.

Por_sha911 02-08-2004 12:11 PM

Wise proverb:
If a man says something in the middle of a forest and there are no women to hear him, is he still wrong?
The answer is yes. Therefore, just say "I'm sorry dear, please don't make me sleep on the couch"

BOTH are at fault. "Compromise": The most powerful word for marriage! Seriously, in this case I think both parties share part of the blame. You need to either get rid of the box of stuff (e.g. get a shelf) or park your cars in the driveway (like 95% of the CA population) so you can fill the entire garage with boxes full of stuff! :D

George

PS: Just for the record: I have 2 cars in my 2 car garage! MY cars. My wife parks on the street!

svandamme 02-08-2004 01:48 PM

this incident is a prime example of why they always want an SUV
to run over our stuff

i say women are evil

Sponge 02-08-2004 02:22 PM

No matter which side you are on, I would say some flowers for the wife would be appropriate... :) (No win situation)

fintstone 02-08-2004 02:25 PM

Nah...whoever was backing up is at fault...cou/da been a small child or pet there just as easily. Got to look before you back up.

I agree. Its not like the box threw itself in front of a moving car. The driver has to be at fault in this case.

aigel 02-08-2004 02:54 PM

I agree, one should always look where one is going. But leaving stuff behind a car is setting things up too. Hence both share the responsibility.

Because she'd run over anything in her way backing up in her pickup truck, that's why my wife parks on the street. She does not even park in the driveway. Yeah, you heard right, I somehow convinced her to drive a parts hauler and project puller and leave all the important space to my cars. :) So much about all women being evil...

geof33 02-08-2004 03:22 PM

Well, I hate to say it, but it had to be pretty funny to see the polish go squirt!!! Too bad for the P-car. Just get's another buff... :D

In terms of "fault" YOU... the man. 'Nuff said...;)

Joe Bob 02-08-2004 03:42 PM

I forgot about the weed wacker she kilt as well.....today she got so PO, she actually said that she will start looking behind the car from now on....the kids also have left bikes behind her car...

RSBob 02-08-2004 07:16 PM

Life is not about who's at fault, or who's more right - that just sets up relationships to be confrontational. Egos need to be put in check. Stuff is just stuff and can be replaced far more easily than relationships. Life is about foregiveness, a good laugh, and not sweating the small stuff. Now if the car was hit and totaled, that would be another matter (wink).

yelcab1 02-09-2004 07:06 AM

I have a small child, 2 years old, that I cannot see over my fender or rear trunk. I would kill myself if this happened involving a child. I am very careful when I back my car in to my garage to make sure that she is no where in the garaga. When she is in the garage, I put her inside one of the car(s), close the doors and the window (she likes playing inside the cars) and then I do my car maneuvering. Inside the car is the safest place for her.

Driver at fault, no matter what you run over.

DavidI 02-09-2004 07:18 AM

In a traffic accident, the person backing the car is usually at fault. It is called "unsafe backing."

Marriage is about compromise though....

adamred 02-09-2004 07:24 AM

Thank God it wasn't WD-40, how would you ever get that out of your car....;)

Superman 02-09-2004 07:34 AM

Oh, this is an easy one. The person with the outdoor plumbing, you know, the one with a "PEN15." That's the person who's at fault. Understanding this is critical to your happiness.

Mark sP 02-09-2004 07:54 AM

Don't know why, but I would have thought that you were the one in the car. Fancy placing a box of stuff behind the car! No offense intended, but why did you do that? Knowing my spouse to be like most other lady drivers, I wouldn't place anything infront of or behind a car that she was likely to drive, lol. However, I would probably have driven over your box aswell, so I shouldn't be sexist I guess.

Joe Bob 02-09-2004 08:06 AM

I placed the stuff behind the car....because I was working on the SC....I was doing rock chip repair for the better part of an hour while she was drinking coffee, taking a shower and blow drying the hair..... The box of stuff was my polishing and paint supplies that I had purchased the day before....

My "other" garage is up the hill and far enough away that I have a 33cc scooter that I zip up and down the street with. I can't do much work up there as yet since it is NOT completely finished....otherwise I woulda been up there.

Since the main garage is a typical 1970s one....i.e., NOT designed for a GMC YUKON XL and to be spacious, it is tight quarters for loading the 3 monsters with school books and other accoutrements.

So...the better half backs the Yuk out and loads up there....not bagging on the spouse....but she has a history of running over things....this time I hope she will gain from the experience and look behind the car before backing up. Last month Dateline did a survey on SUV blind spots....the #1 accident is backing over things that shouldn't have been there.

It's a good habit to look behind your car before pulling out. Hopefully we can ALL learn from this....

BTW....I;m STILL cleaning out polishing compound from the wheel wells and underneath.....

Groesbeck Hurricane 02-09-2004 09:31 AM

Mike,

No matter what, you should take the blame and the happy marriage. I hope that I could take that advice but I know there have been occassions when my wife has taken the bullet for me! Yes, she should have looked and yes, you should not have put the box behind her vehicle. The driver is responsible for ensuring the safety of their actions but losing an argument, saying yes dear, I am wrong, will win more for you in the long run.

And when she makes the same mistake, you can just rub it in that much harder (the imp just couldn't resist!) SmileWavy

A friend of mine was well known for hauling ass out of his garage without looking. Hit lots of stuff. Always pissed because someone left a bike, scooter or something behind his car.

One day he ran over his daughters life-sized doll. Scared him to death when he first saw it. Now he always circles the car from the back before getting in. Good idea for all of us.

In 1600-1700's Salem when this occured with horse and buggy, it was mandatory to burn one of the two parties at the stake.

Have her carry orange cones in the car that she has to place in front and rear when she parks :D company policy.

Just wait till your girls are driving too, Mike :p

MFAFF 02-10-2004 02:54 AM

Sue for emotional and moral damages.

That way you can still be a winner, even if you are wrong.

But get this.

I have a large box in which all our 'domestic' tools live.....I needed it to fix some stuff in the house over the week end.

I leave it out whilst doing said stuff......pretty logical. NOw home comes little miss and kiddie.. OHHHH tolls says thelad, AHHH tools says his mother... So tool box gets tidied away and stuffed into cupboard.... All very logical.

Now in that box was a large can of WD40.......now the WD40 is out of the can and all over the inside of the tool box, the tools, etc etc etc.

Whose fault, mine of course as I had the tools out in the first place.....

Anyway she's on kitchen duty for the week.....as if she minds and I have to clean out my tool box (   ) next week end.

Plus I get to make fun of her at any time.

Isn't life grand.
