What ever happened to due process?
I just got back from a family vacation in Hawaii. (Beautiful place!)
Anyway, I stopped at a local corner store to buy some beer. The girl behind the counter asked for my ID! I'm well on the other side of 40 and look every day of it. I laughed and she explained that the owner has been having problems: A 21+ year old with valid ID buys 2 cases of beer. Off site and out of the view of the store owner, the beer is distributed to teenagers. Kids get busted. Beer sale is traced to local store. Instant $500 fine. You can appeal, right? You have video of the beer sale. No sale was made to minors. You can prove it. Not so fast... In Hawaii, if you appeal the $500 fine, they will lift your license to sell alcohol pending outcome of the hearing. Is this crazy or what? |
Its crazy but it could be based on old Hawaiian law. If I was the store owner I would find the person selling the alcohol on the street. By the way, how can they trace the purchase?? From a receipt? Otherwise unless it is in the store parking lot, the store owner should not be liable. If it was in the parking lot, the store owner would probably be negligible should something happen especially if he knew it was happening. Glad you had a good vacation, you should post some pictures.

A few bars in CA have actually started Sueing underage drinkers with fake IDs for lost profits due to their deception.
I think THAT is right on. Kids drinking is wrong...Parents need to teach their kids that it is wrong. My Dad taught me - he got me a bit drunk when I was 13. Fully supervised - I was drunk (Maybe 2 beers), mom was pissed but I didn't touch alcohol again until I was near 22. Parents are responsible for the actions of their children - if a kid gets caught drinking underage the parents are responsible for that - If I was the store owner I would find the kids and go after their parents. |
