how to sell used guns legally??
For everything else there is Ebay.. What is the best way to sell a colt .45 pistol without getting in trouble but also collecting a fair price? maybe a dumb question but I don't usually sell my guns.

Basically you've got to transfer thru a licensed firearms dealer. It costs $40 to send and $40 to receive.
Any other type of transfer sets you up for a potential world of hurt with ATF.

We sold our guns on consignment through a gun shop. Before leaving them there we agreed on two numbers... expected net and minimum net - to give them a little negotiating room. The difference was about $50. It took them no time to sell both guns and we got the "expected" amounts.

What they said above re licensed firearms dealer. Addtionally, you could always sell them to a pawn shop.

I used to have an FFL and by moving to Las Vegas I had to give it up...and am now a civilian....Also I came from the Peoples Repblic of California...which had some of the most strigentt gun laws in the USA.
Here is what you have to do to sell a gun .... You can advertise the the gun in the GUN LIST....(Krause Publications) 888 457 2873. It's $.0.28 a word minimum of 13 words...Or you can take a picture of the gun and put it on Guns America.....with a description. Your going to need to find out what your gun is worth and place an ad. When someone decides to buy your gun they are going to have to send you an Federal firearms license from their local gun dealer..to take care of their local laws....your going to have to get their check and hopefully part of the deal is that they pay shipping...Once their check has cleared your bank you send the gun to the FFL Dealer whose license you've received. I find FED EX GROUND is the best...UPS on a handgun wants to ship 2 day Air which is $40...vs $15 or so for Fed Ex...YOU INSURE THE GUN FOR IT"S VALUE...The buyer has a 5 day right to refuse the gun if it's not up to their expectations..thats why it is important to tell the buyer everthing you can about it's conditon in an honest way...you don't want it back... If they do send the gun back they have to pay for shipping.. If your buyer is local..then you need to go to an FFL Gun Dealer and do the transfer ....the buyer has to pay for the transfer...

Oh by the way WHAT KIND OF 45 Pistol do you have...and please note the serial number and condition (how close to being BRAND new) on a scale of 1 to 10 ..10 being best...I am always looking for Colt 1911's and Colt Single Actions and even like Smith and Wessons...

When I tried (getting my S&W 29-2 featured elsewhere on the forum), I couldn't get FedEx or UPS to ship a firearm. Even from the private party to a FFL. Ground or otherwise.
The FFL on your end has to ship to the FFL on the customer's end.

It's a series 70 custom built match grade. I have over 2 grand invested in it. It is in perfect or near perfect conditon. It should be worth 7or 800 or maybe more shoudn't it??

Not True....the law reads from a private party to FFL...to private party....it's the same as you taking your gun and walking into the dealer and giving it to him except you have a shipper involved.... I have talked to a BATF agent about this in September....UPS Policy is anti-gun and they make it difficult ....
Or if it is a warranty/repair issue...and you send the product back to the manufacturer...who has a Federal License... You just can't ship to a private party...

Custom Guns are always difficult to get your money out of...if you have 2K in receipts...and the condition is like new with few rounds through the gun than I would try...1300 or so and work down if you don't get a response from an ad in the Gunlist in 3 to 4 issues..
I find you might sell a gun on the Gun List for a little less than you might get at a High End Gun Auction, or maybe a Gun Dealer...but you don't have to pay the commission either..so selling it yourself nets you just about as much money as your going to be able to get.... It's funny but I always watch the response to my advertisments....if I don't get a call in several issues then I know my price is too high...and if it sells even before the paper is released than I know I might have sold to cheaply...or I have something VERY desirable....

Stock Colt Series 70's 1911A1's are going for $850 plus now...that in mint condition....You have receipts on a CUSTOM gun which KILLS the Collectability of it...so you have to find the RIGHT person who wants a gun with your modifications...Custom or semicustom 45 Manufactureres are doing well now because alot of guys want Custom features on their 45's....If you have 2K in receipts then start asking something like $1550 and see if you get any bites...if not in a few weeks drop your price till you get a buyer.... I think the gun should go for right around $1000 or so...

You will get a bit more usually by selling it to a private party. The current laws and such about registering weapons have made it so that people prefer to buy a weapon directly from a private party these days if possible. Was at a gun show this weekend and loads of people at the front door selling weapons privately.

I want to say in Massachusetts you can legally sell up to one gun a year private party, and I don't think that requires any paper work. There must be some rules about selling to someone with an FID card, obvious stuff. A local weekly magazine in NE, The Want Advertiser, which sells just about anything private party, has a section on guns and I've never known anyone to do the dealer thing around here.

We do not even want to go there! I was laid off 3 weeks after 9/11 and had job offers all over the country. CA, MA were totally off limits as was DC, HI and NYC. Cali is rabid about anything that holds more than I believe 7 rounds in it, and DC its illegal for anyone to own a pistol. Hawaii takes a year to get a weapon approved. Mass has a law on the books that if the police "believe" that you could be a danger to anyone, that they do not need a warrant, and can just come into your house, sieze your weapons and throw you in jail. Period, do not pass go and when you are lucky you get to call the lawyer. Have a good friend whose Brother is a gun dealer up there. He says that since this law came into being that the number of weapons being sold as you mentioned, between private parties with no paperwork being done, has more than doubled. No one wants the paperwork nor the cops knowing anything that they have in the house if at all possible. They are not criminals, have done nothing wrong, but feel that the state is overstepping its boundaries and are going around the new law. There are enough states who let an individual have a weapon without dragging a ball and chain behind him. Do not see how you guys put up with it but thats for you guys to deal with. We can wear a gun on our hip out here in the West with no paperwork and no hassle. Joe

I'm not saying I actively participate in any illegal activities regarding gun sales/control. I was until now unaware of the law "on the books" that you mentioned (you meant it was a bill, right?), although it is extremely scary. MA does indeed suck quite badly regarding guns and gun control. All it takes is a look into Cabella's or the Sportsman's Guide to see all the good stuff can't be shipped to MA or CA. Its very tough to deal with, as you mentioned, hence my NRA membership. We can also wear a gun on our person, with a License to Carry.
Unfortunately, its just a matter of time until we can't have guns, it seems inevitable. |

Not at all intending to give the feeling that you were doing anything incorrect, I personally could not put up with the laws that are on the books in MA regarding firearms and refuse to even think about living there. Its not a bill, its a full blown law and has been used several times already. Unfortunately, its just a matter of time until we can't have guns, it seems inevitable. May be from where you sit, but as Chuck Heston said: "when they pry the gun from my cold dead fingers" and here out West that will be a very long time! Attitudes like that got the weapons siezed in England and Australia and pistols in Canada. Aint gonna happen anytime soon here. Joe A

Last time I picked up a Gun List newspaper it seemed much smaller than a few years ago. Has anyone tried the www.gunbroker.com site?
