This pretty much covers everything!
This is the last paragraph from my waiver of liability for a dive trip to Belize. I didn't know they had liability issues in Central America. The "wrongful death...whether active or passive" part cracks me up.
I ACKNOWLEDGE THAT I HAVE READ THE FOREGOING PARAGRAPHS, FULLY UNDERSTAND THE POTENTIAL DANGERS INCIDENTAL TO ENGAGING IN SCUBA DIVING, AM FULLY AWARE OF THE LEGAL CONSEQUENCES OF SIGNING THIS INSTRUMENT, AND THAT I UNDERSTAND AND AGREE THAT THIS DOCUMENT IS LEGALLY BINDING AND WILL PRECLUDE ME FROM RECOVERING MONETARY DAMAGES FROM THE ABOVE LISTED ENTITIES AND/OR INDIVIDUALS, WHETHER SPECIFICALLY NAMED OR NOT, FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE.

I wonder how the "Released Parties" could "Actively" patticipate in a "Wrongfull Death"..... thats what would worry me...

Can't release "negligence" caused by someone else. If the guy running the service accidently allows carbon monoxide into the tank you use - he is negligent no matter how many releases you sign. You are not responsible for his error and cannot release him from them.
Bottom line - you (or your heirs) would still be able to recover damages.

I don't have a copy of the wavier, but I was dumb enough to try bungie jumping in south carolina several years ago. The release had all the usual releases. The last paragraph- and I am paraphrasing but the meaning is the same- basically said By signing below I acknowledge that I understand that other nearby centers may have more completely trained staff, and may have more better safety standards. There are certainly jump companies that have newer equipment. I realize and acknowledge these risks........
I thought that one covered just about everything. I am glad my surgeon doesn't have a similar wavier gary |
