Walmarts trying to trademark because another guy (French) is trademarking it around the world and wants royalties for it. How can you trademark something that's been in the public domain for decades. I don't think anyone will be successful in the US patent and trademark office on this item.

We have a large family owned superstore that competes with WalMart in just about every city in Michigan.(Meijer)
They have billboards that tout "Our smiley faces are on our customers". I do business with these the Meijer stores so I shop there. You can find the same things there as Walmart. Yep, they have stuff that's made in China, too.
