I've had chicks work my zipper for me, so this is a lot like birth control, not 100% effective.

Most states have adultery statutes, many still have sodomy laws, and some still have laws on the books that prohibit mixed race marriages. Birth control was widely outlawed until 1968. The statutes have pretty much all been invalidated on privacy or equal protection grounds or just fallen out of disuse so they haven't been reviewed by the courts lately. Laws stay on the books, even when they've been invalidated or fallen into disuse unless the state cleans them up.

It appears that Michigan is an exception if they still have the law and someone is pursuing it. A few years ago a guy in Western Wisconsin got his local DA to prosecute his ex-wife for adultery after he found out she was having an affair. The prosecutor did charge the case (against the ex-wife only, not the other man) but after he was roundly humiliated for selectively prosecuting the first case of its kind in 50 years, the case was quietly dropped. I think the court's response was that this is something handled better by family courts rather than the criminal justice system.

A bit of trivia for you. The standard common law definition of adultery used to cover married and unmarried women but not unmarried men. An unmarried man could have sex with a woman who was not his wife; she would be committing adultery, would not. Just the way things were back then.

Irrespective of who is opening your zipper and for what intent, how is this any business of the state? Or of anyone else beyond the 3-inch-deep happy zone in front of your trousers?

How is this any different than the workings of a Muslim theocracy?

Yes, laws stay on the books long after they are obsolete and antiquated. Some of you know, and I wish you all did, that legislatures are darned lazy. They write many vague laws because they can't really reach a decision. So then, the thing I continue to wonder about is.......

Why you guys are pretending that the courts are overstepping their boundaries when they are forced to interpret these incomplete laws passed by spineless legislative bodies?

Even more trivia - a guy fools around and has a baby outside of his marriage - is the wife on the hook for child support?

Now lets say wifey is out there screwing around. You bet your last dollar you are paying child support.

The way things are now is not so great.

I am happy to report that there is a real answer to this question. If a guy fools around and has a kid with his mistress, he is responsible for child support, regardless of their relationship, whether he's married to somone else, etc. His wife is not responsible for it, but obviously gets less support from hubby if some of it goes to the out of wedlock kid.

If wifey gets pregnant, it is presumed that the husband is the father unless (and I am stretching my memory here for the archaic language) he is out of the country or in the service of the king at the critical time. The presumption can be rebutted with blood tests showing that the kid was fathered by someone else.

However, there was a case I read about in the ABA Journal a few years ago where a state adopted a rule saying that the kid's interest in having a supporting father was more important than the non-father's interest in paying only for his kids. That involved a couple who split up after raising the kid to a certain age before ex-hubby found out.

So while the general rule is no, men are not responsible for their wife's lover's child, there are some circumstances where the state will ignore a blood test and adjudicate the husband to be the father.

The biggest tragedy in cases like that is not the man who is getting caught paying for his wife's lover's kid, it is the kid who will inevitably find out that there was a court battle where the two sides were fighting to not take care of him. Kind of like the kid on the playground who no one wanted to choose sides with. Can you imagine what that would do to a kid?
