Any homeowners insurance agents here?
Can you tell me what role the Certificate of Occupancy plays when making a claim?
18 years ago my brother did a home improvement, with a permit and licensed contractor, but waited and waited for the town to do the final inspection. They never showed up so they closed everything up. Does he have a valid CO? If not would the insurance company be justified in refusing a claim? He's afraid to appraoch the town for fear of having some serious repercussions. Any opinions? Any advice on how to proceed? TIA

Read the homeowners insurance policy. In my experience I've not had that situation come up.

Thanks I'll recommend that he scan the policy thoroughly ,but which situation heve you never experienced? The inspector not showing?

Your insurance commission may know
Call the state insurance commissioner's consumer help line and ask them. They may be able to answer whether a company can deny a claim for not having a document they didn't ask for before they insured your brother. As earlier stated the policy may also state the a certificate is required for coverage.

To offer any advice we need more information. What kind of claim is he making and what relationship does it have to the home improvements? The C/O would have been issued when the house was first new before it could be sold and occupied. The home improvement shouldn't have required a new C/O unless it was a total rehab. What state is he located in?

In th business for 20 yrs. The company is trying to determine if this is course of construction related claim. If it is coverage could be limted (no theft).

I've never seen a CO play a role in the claims process. Is there a loss or is this just a what if? Most companies will not answer whether coverage applies under a what if question as they are rarely given all the facts. Most polices reserve the right to rescind the policy if a material change has taken place and they were not given the opportunity to re-underwrite the risk. (limited coverage) Who has the responsibility for the inspections? Sounds like the licensed contractor may also be in the loop.
