Video: Trespassing health inspector?

This video is making ther rounds on the 'net. It shows a Health Inspector entering a private property with an Indiana Sheriff. The owner claims since he did not give them permission to enter and that they don't have a warrant, they are trespassing.

Interesting here, what do you think?

Sounds like the guy might be living in a nice new house by now paid for by the state of Illinois.

Was it ever clear what she was looking for and what's with the black gloves on Barney Fife?

Only excuse I can think of is if he was digging around and moving dirt from a septic drainfield.... but if a complaint was lodged by someone else, then the health lady shoulda had some paperwork, etc. to back it up...

Somewhere in the video I heard him say "All I'm doing is moving some dirt around. If you're concerned I'm dumping sewage than you should have a warran for just cause"... ...or something like that...

"If you don't have anything to hide....."

My observations/opinions:
A) The videographer is already wound up beyond reason and is unable to have a calm discourse. And I think some of his "legal expertise" may be off kilter.

B) She, like many "public servants" believes that her job supersedes all individual rights.

C) Deputy, caught in the middle without proper training, decides to do nothing.

What I think will happen:
Nothing.

Why?
Because personal rights are an illusion. You have personal rights all the way to the time that somebody with a badge or an office decides you don't. Constitution? WTF... that's just a piece of paper.

Man, stuff like that makes me angry. I may not be up to date on the US constitution, but isn't that what the right to bear arms is for? When someone's trespassing on your property, do you not have the right to physically remove them? I would have, and if the cop wanted to arrest me, have at it. It's all on videotape. I'm not saying he should've drawn a weapon - in front of an officer that'd be suicide, but I would have forcibly stopped her from entering my property.

I hope he sues and wins big time. That's a clear violation of rights. The cop should be fired.

You most certainly cannot shoot a cop for trespassing onto your property. Nor can you shoot any other unarmed person if you cannot demonstrate a reasonable fear of death or grave bodily harm. Any cop can walk up to your door without a warrant. How else would they be able to serve you papers or ask for your consent to something for which he doesn't have a warrant? The key is to not let the cop inside the dwelling and not keep the door open long enough for him to look around and possibly catch sight of something that could give him reasonable articulable suspicion. But anyone walking on my property in any way other than up to my front door to knock and ask me permission, well, I'd consider that trespassing.

You can defend your property in Texas, it is the law.

I would have told them to leave, and if they tried to enter I would restrain them. I would ask the deputy if he was going to stand by and allow this person to tresspass on my property, or if he was going to act like a law officer, especially if I had a camera on me
