Anyone familiar with FLA taxes

Hello all,

I am looking at buying a 3.2 in Florida. The owner of the car seems to be under the impression that I will have to pay the 7% tax in Florida even though I am plating it in NJ, does this seem right? I would assume that if I pay the tax in FLA then I don't have to pay in NJ.

At least in CA....it depends if the seller is a dealer and if you pick it up in the State. If it's shipped or sold out of state...no. Sold and picked up IN State, yes.....the NJ DMV MAY give you a credit.....best to ask them.

Sam -

If you are buying from a dealer in FL then in most cases they go ahead and collect the tax on the car when sold as they have to make quarterly payments to the state on their business dealings,

You do get a form from them which covers the tax you have paid which you take to your DMV to register the car, they will give you credit on this tax and then in turn obtain the tax from the state of FL, this happens all the time,

Having said that if the FL tax is greater than your state tax you do not get any type of refund, FL just keeps that money...lol

If you are buying from an individual than this is a moot point as they are not required to collect or pay the FL state sales tax.

PS.... not all FL tax is 7 per cent , some counties tack on some additional sales tax which goes directly to them, also the tax figure used does not cover the entire price, IE.... the 7 percent might be on the first 5 K of the price then it might drop to 6.5 percent on the remaining cost or something like that.

Thanks guys, I am buying from a private individual. I assumed that I would transfer the money to him, he would send the title and receipt, I would register the car, fly down pick it up and drive it back. He mentioned that we would complete the transaction in Georgia negating the need to pay FLA tax, seems kinda complicated to me.

Sounds fishy to me.....get an insurance binder, a temporary transfer pass from NJ, get the title HE has, pocket it and drive home.

Don't know what you are working on but something sounds a little fishey to me,

There are NO requirements for an private party , non licensed car dealer , to pay FL sales tax on a car they sell you . Period .

If he is telling you something else he is yanking your chain and just hitting you for a few extra hundred bucks , or he might be just plain mistaken in his belief.

Where are you buying , I live right on the FL / GA border on the East coast , so if you need help or a local eye give me a shout on email,

Mike - if he has full insurance coverage on any other vehicle he would not even need a binder in most cases as new car purchases are immediately covered for a short period of time to allow processing to take place when added to his current coverage, but if you wanted the extra security a binder would not be a bad idea.

Thanks for the replies Mike and Todd.

Todd, the car is in jacksonville, I have already seen it and it is waiting a PPI, but thanks for the offer of help. I don't think the individual is doing anything underhanded, he is an attorney and may be overt thinking things, there is no extra cost to me.

Heh heh. Have K9 show up to check out the vehicle and transaction. Just make sure K9 does it in his "work vehicle." That'll give the seller any second thoughts on trying to pull any funny stuff.

Should he charge you taxes and you pay them to him, advise him that you will be sending copies of the related documents to the Florida Department of Revenue so as to make sure you don't pay twice and let them know he collected them. No sense becoming a co-conspirator to defraud, etc etc. He will get the idea. One of two things going on. One, he is hitting you up for more money or he has no clue what he is doing. Good luck.
