I need a NY Traffic Ticket Attorney to avoid "Porsche Tax"
Anyone know of a decent NYC traffic lawyer? Got a "Dangerous Driving" ticket for pulling ahead of the car which was next to me when the light changed then I moved in front of it. The car was on the left and hesitated when the light went green. I was thinking the driver was waiting to make a left turn or looking for the accelerator pedal on his new Toyota Yaris. The street ahead narrowed to one lane due to a parked vehicle. I was neither speeding or being erratic. The car was safely behind me when I moved into his lane. I am guilty of driving a Porsche -- it makes a nice loud whooshing sound flat six sound. They would never give me such a ticket in my VW. The M3 maybe.. but probably not even. Got pulled over 2 times last year in the Porsche no tickets were issued. The other cars I drive in the same manner and don't garner as much attention from Johnnie law.
This ticket could be between 2-5 points, does anyone know? Or know how much the fine is? The person at the DMV said two points (on the phone) and it said five points on the website. I fear the website is correct. My insurance could be crazy high next year.. For your information the back of the ticket implies that one must plead in person if you want to plead 'not guilty'. NY tickets are not forthcoming about the fact that you can mail in a NOT GUILTY plea. The language is evasive on this point. It is not convenient to plead 'not guilty'. They also want to scare you into paying up with suspension threats. I am sure this confuses the majority of the population into just paying the fine. What I did was not dangerous at all or I would 'gladly' pay it. I see a lot of crazy crap driving in this town. You want dangerous i will show you dangerous! Any advice from you educated folk would be appreciated. The one time I hired a traffic lawyer ten years ago, it was not a waste of time.

are you sure it's not a "reckless driving"....it would cited as a violation of section 1212 on your ticket. If it is...then they wrote you a Misdemeanor ticket...which is actually a crime. Also, did you get in one of the boroughs? If so...major PITA to deal with. PM with the information. I defend Vehicle and Traffic tickets for a living. My advice is don't send the citation in to the court. Take it to an attorney in that NY County where the traffic stop took place(the yellow pages could be as good a clue as any, the lawyers often distinguish their specialty practices that way). Perhaps he or she will send a letter to the DA and offer to plea to a lesser charge, such as failure to obey a traffic device(2 points). You sign up for the plea if offered. In some counties it works because of the backlog in the court, ie, if it can be disposed of with letters between the clerks, it saves court time and expense. Then you just get 2 bills from the attorney, one for the fine with the NY State surcharge which about doubles the fine(you will make out a check to the court) and one bill for the attorney's fee. Simple. Good luck, stay cool.

Oops, I forgot one more thing. You will probably need your driver's abstract(a history of your driving career from the friendly local DMV office for $10.00 and the attorney sends it in with the plea letter. Hopefully, you have a good record, it helps in this case to convince the DA you are not a menace on the highway needing a lesson.
