Will my sisters insurance go after me?

I will try to make this short..

I had my sister, her husband and thier 4 boys over for a cook out at my place while my wife was away in New York. My sisters oldest son was swinging on my swing set and just let go, fell to the ground and got a compound fracture in his arm. he went to the ER and underwent surgury and now is casted up and recovering. Is my sisters insurance going to come after me to recover the > $15,000 hospital bill?

Back ground on my sister...

She sues people for fun to try to come ahead financially. Even if someone bumps her from behind in a vehicle she tries everything she can to milk the thing out. It seems she is in a accident every 2 years which pays out big. This is how she got her downpayment on her house.

She went after her husbands dead grandfathers estate for hospital bills because one of her inattended childeren fell and hurt themselves on the property.

She had her oldest son on behaivor medication for 3 years and one of the side effects is reduced bone density. This boy is now 10 years old and has broken his right arm 3 times now and his left once. The arm brakes were results of 1) falling off a ball he was balancing on. 2) falling off a downspout he was climbing. 3) tripping over his own feet as he was running. 4) falling off the swing at my house.

It is becoming more apparent to me she doesn't watch her kids worth a dang. Her youngest was wondering the streets 3 blocks away for 20 min and she didn't even notice. The cops finally brought the kid home. The boy was 2 years old at the time.

Do you think either she or her insurance company are going to try to sue me?

I am thinking I shouldn't allow them on our property ever again....

Sounds like the real victim here is the kid- 4 arm breaks?!

I had no idea that behavior modifying meds could reduce bone density to that degree. Could it be that its never healed properly in the first place? Thats just a lot of arm breaks. I hope it doesn't mess the kid's arm up for life.

It would be nice to assume that she will not sue but based on past history, you may want to tell your insurance agent about the fall. I would not allow them on my property again... sad but true. Sorry.

Not sure I'd be worried about the insurance company, but rather, the sister.

The last time his arm was worked on by the doc it healed with a 5 degree bend in it. The even rebroke it to try to get it reset properly but it didn't work. If a bone has a 5 degree kink in the middle of it there is no way it will support the same amount of force as a bone which is straight.

I love my sisters kids and like to spent time with them. I have mixed feelings about my sister and her husband and how they have dealt with accident situations in the past.

My sister even asked my Grandfather for her share of the inheritance now before he dies. I told him right in front of her that he should spend every last cent of everybodies inheritance before he dies by traveling the world. Make sure to leave nothing behind for anybody. You should of seen the look my sister gave me....

Wow. You're screwed.

She'll sue you. Your insurance will settle. They'll get pissed at you. You'll be pissed at your sister. She'll be happy. But you can say goodbye to any good relations with her ever again. I suppose you can threaten to report her to DFS if she threatens to sue. Either way, unless she decides to not sue, I see only bad potential outcomes for all involved. Sucks to be her kids. Doesn't sound like she really deserves 'em.

Sorry bro, this sounds like a terrible emotional drain. I'm afraid i have to agree that the chances are she will sue your homeowners insurance. Prolly justify it in her mind by saying that its the insurance co's money not yours. I hope I'm wrong Speedy.

I suppose you could counter-sue based on the kid's medical history.

No, you aren't going to get sued for the hospital bills.

From that, I gather the kid's hospital bills were covered (paid) by your sister's insurance company. Therefore, your sister no longer owns the claim, she has contractually subrogated the claim to the insurance company. It is up to the insurance company to decide whether to try to collect it from you. For a kid falling off a swing, they won't try, because it's not a good claim.

I'm very sorry to hear this Speedy. This is a tough situation.

I would stay away from her, but I understand how it's tough to do to family.

I would say that it is highly unlikely that her health insurance will come after you. I would say that your real worry is her suing...and then your homeowners policy would cover you.

I got myself an umbrella policy a few years ago when my dad died...it has much higher limits for lawsuits than a basic homeowners policy. Most insurers will not offer them unless you have your house and all of your cars insured with them, but for me it is worth the peace of mind.

Still, the more I think about it, if she let her insurance pay for it, she would have a tough time proving she suffered a loss and is due damages.

I'm glad your not like you report her to be. Does she have free access to legal advice? Your statements sum up everything that is wrong with the legal system. Everyone that is paying insurance premiums is in one way or another helping to pay for your scum sister's downpayment. I'm sure the lawyers representing her are spinning it that they are doing good. Here hoping Karma catches up with her. Get ready to drop all you saving for legal fee's in the meantime.
