Employer and a labor law inquiry ( exempt emploee & overtime )
Question about an office manager who gets paid by the hour plus some fixed salary totaling ( net ) $1200+/biweekly,also does other administrative work including supervising quite a few full time employees and who also helps deciding who to hire and fire...is she considered an exempt employee ? Does she qualifies for the overtime ?
The only doubtful part is the method of her being paid ? Although she is not salaried but her pay check has never been less then the amount mentioned above...The fair pay act of 2004 says they should make at least $445/weekly as a salary or as a fee ? can some one help explain this to me ? Feedback much appreciated.. |
