Paypal dispute options
 
I searched but couldn't find anything fitting my problem.

I recently won an Ebay auction for a Porsche part from a local seller. The part is a rear quarter panel for a 911. In the picture and the description it showed a small dent at the bottom of the panel but otherwise nothing else.

After seeing the panel it has two other dents, one that is creased pretty badly and also a big saw cut into the panel where it was carelessly cut away.

I disputed it with paypal but here is my problem. I had recently sold some stuff and so I had a positive balance and the payment was deducted from it so I don't think my credit card was involved. Am I basically screwed or can I get some kind of satisfaction from this debacle?

Update. The seller has informed me they are refunding my money. Keeping my fingers crossed.

2nd update. I was refunded the total amount.

The question still remains though about getting money back if the seller didn't do the right thing.

Ebay owns paypal, and they enforce their rules when, if, and how they choose.
I NEVER leave a balance in my PP account for the reason you noted.

Whatever you do, do it before the deadline (30 days?) of sale. I was 12 hours late and they said tough bananas. I know now to stop corresponding with the seller and get action going with paypal before time runs out.

Paypal has refunded my money on my only other dispute, so they aren't completely worthless.

I was under the impression that having a balance or not wouldnt matter - I thought they could go directly into whatever source you have - like a checking account. Thats why I have a seperate checking account (most banks do it for free) that I transfer my balance into THEN I move it to my primary checking account. I guess I am being over cautious.

They cannot go directly into any banking account you have on file, the only way for them to remove funds is when you authorize it by " paying " someone.

If you have a postive balance then they can take the funds from that balance without your permission or knowledge.

I learned this the hard way to the tune of $3500.00 dollars on a deposit I paid on a roller, the car showed up was a POS and when I went to them to retrieve my money they told me the " seller " had deducted the funds from his PayPal account into his bank account,

When I asked them to access his bank account and recover my money they told me " no way to do this, that it is illegal for them to do so " , in the end I was basically **** out of luck and lost my money, funny thing I even sent the POS roller back to the seller and he re-sold it on Ebay a few weeks later to some other poor bum.

In my only ebay dispute, Paypal refunded my purchase price with no problem once I layed out the scenario.

A good friend of mine is a big dealer in rare and collectible video games on eBay.

According to him, once money has changed hands and Paypal (and eBay) have gotten their fees, you are pretty much f***ed. They could care less.

Now, if their fees are at risk, then they tend to move a little faster (like at a snail's pace).

never had any luck with getting a refund

most recent - purchased a watch band for a little project I was working on - the band that arrived was entirely wrong - and seller refused to make good

paypal asked - did you get a watch band - I replied with "Yes, but the wrong one" they replied with "We do not refund money for items that are not as described"

Paypal refunded me $500 for a POS amplifier with no problem whatsoever (it took several weeks however). That's my one & only experience.

Sorry but this is not correct. If you have a bank attached to your account, they can and will either take the money from your account or put a lock on your bank account so that you cannot access it either.

Put a credit card on the PP account, never a bank account. Also make sure that the credit card is not a "debit" style card and does not have any overdraft protection on it.

Everyone needs to go to www.paypalsucks.com and take a look at some of the games PP plays.

Those PayPal wipe heads lied to me then and did not help me get my money back , they swore up and down that they could not go into that guys bank account to get my money once he transferred it there.

Not a good idea to buy expensive items on ebay. Cars and "Rolex" watches are two examples. With cars, look for a local listing and see the car. If it's good, the seller will likely take it off ebay to sell it to you. Saves commission. With watches, go to a Rolex dealer. Too many fakes around.
