No.... Just for starters, what if in a couple of weeks someone makes a claim for injuries and asserts that Moses was somehow at fault?

The accident was in a small corner of the back yard. There are a few trees, a small section of lawn and an arbor with a hot tub underneath.

The brakes would work perfectly fine in the scenario you describe for 1 or 2 stabs at the pedal.
