Should the getaway car driver be executed?
I heard today on the radio that Florida plans to execute a guy today. (Forgot his name, and can't find the story on the web) He was in the getaway car while his partner in the store murdered the clerk.
I suppose if they proved that the clerk was supposed to be killed all along, the guy should fry. But FL says if you are involved in any way, you fry. Opinions? To me, it seems too harsh in some cases. Maybe there's more to this particular case. |

Perhaps if he wasn't an armed robbery get away driver this wouldn't be of much concern to the lad.

Yes, he should fry. The law states you are culpable if someone dies in the commission of a felony in which you are involved.

Actually I think it's in Texas.
If he was only in the car and didn't know what was happening, I'd say the death penality isn't called for. It sounds like the driver went into the store after the murder and helped his accompliance rob the store. If that's the case, fry him. |

No one can tell me he didn't know exactly why they were at that store. He should choose his friends better. The message should be loud and clear for punks nationwide: if you are even with some one who tries this crap, you'll go down as hard as he does for whatever he does. I Cali, if you are with a robber (as in the accomplice) & he gets killed during the commission of the crime, you are charged with his death (even if the police killed him)
I say fry him, it would be nice if Cali would clear out some of the death row backlog, i think there are something like 650 thugs waiting for their day to come |
Let's see, he knew his buddy was robbing the store and was doing it with a loaded gun.... One possible forseeable outcome is that the gun gets used. Besides, he was part of a team that planned this. He could have just as easily been the gunman and not the driver. Don't see a problem here.

I do not believe they should execute him unless it was clear that he had prior knowledge that a murder was about to happen. I don't buy the "Well, he SHOULD have known" argument. Some folks are dumber than stones, and criminal types don't always know each other too well. He may not have known the trigger man was a nut.

Say a couple of teenagers go to a guys house to give him some knowledge bumps for messing around with one of their girlfriends (stupid but not unheard of). One loses his cool and kills the guy.
Do they all fry? To preempt the question, yes she's hot. :D |
