Don't vote for a lawbreaker
This goes for any and all parties.
Don't vote for a party that will break a law (and do it openly and willfully). The Libertarian Party is the only one that put their presidential candidate on the Texas ballot in time, by Texas state law. This is not a new law, not a changed law, not a surprise. The Big Two are just so full of hubris that they never bothered to file on time. The other small parties are accepting a write in candidate position. If, in the next 68 days, any other party gets on the ballot in Texas, they have broken state law. More than likely, it will be currently sitting judges or lawmakers that allow this...THOSE people should then be removed from their positions immediately. Don't vote for a party that will support such rampant, blatant, glaring lawbreaking. http://www.sos.state.tx.us/elections/candidates/general/2008gensbs.shtml

While my thinking aligns pretty well with libertarians, I also think voting libertarian is throwing my vote away, as the Libertarian candidate has no chance of winning.

Um...no. If the tables were turned (which they often are in these elections), the state would tell the independent party to shove off if they didn't get their paperwork filed on time. Do you think that a major electoral contributing state will tell the Big Two to shove off? No? So they'll let them break the state law, just because.
That's BS, and just as bad as any of the stuff that the pro-Demos or pro-Republs fight about.

Of course, those 4 states make up over 25% of our presidential votes. 25 freaking percent. In 4 freaking states. Yeah, aren't we glad we have a democracy.
