WOW!

Just a quick question.

If officer B shoots your client dead [probable], & yourself, the judge, & the prosecutor all know about the death threats, [ regardless of being on/off the record] , will all parties then consider their duties to have been 'fullfilled'?

Well, its 5:30 a.m. and I am up doing final prep for closing arguments on the one remaining charge (DUI). This judge has not dismissed a single DUI appealed to his court in over 5 years.

Wish me luck. I'll need it.

You remind me of my Attorney! I don't know what you guys do behind closed doors but its amazing!! My attorney never gave me any good news until I got a call that said all the charges are dropped except one, I said I would admit to what I did, and he even got those tossed, how do you guys do it?? I went through 2 prosecutors because they were lying and we could prove it, then at the end the Chief Prosecutor (last guy standing) did everything but apologize to us. I don't care what others say, you guys earn every cent you make!

Thanks for your well wishes....unfortubnately your efforts (as mine) were in vain. Judge did leave me some room to win on appeal. Unfortunately my client probably can't afford it. The transcript alone would be $1700 and bonds would be another $2500.

We'll see.

So the judge convicted this man despite the fact that the cop is an obvious liar and fraud who should have his badge stripped, even in the total absence of a breathalyzer?

Yeah, he belongs on the bench.

Been there too! Had an Insurance Company I sued try to win by running me out of money, Didn't work:D

We call him the prosecuter in the black robe. He gets reversed on appeal more than any other judge. He doesn't care...the mad mothers keep getting him reelected.

Don't get me wrong...I only take on dui cases that are winnable. Most that are clear cut cases of dui I tell to pay the fine, not me, or get another lawyer.

That sucks , and ***** MADD , it's a terrorist organization. Not that I'm in favor of drinking and driving but they would move it to 0.05 % nuts..

I feel you Dueller. I do not drink and drive, i think it's totally irresponsible, but in this case, assuming you're being honest and forthright, this is an absolute miscarriage of justice.

So what's the latest on the cop?

Honestly, I don't care about the bogus DUI conviction, I want to know what the deal is with the lying cops.

Has officer B killed anyone yet? When he does, you should represent the survivors of his victims in the civil suit against the County, or whoever is going to be holding the bag

I once had a cop lie under oath telling the judge "his version" of the story, and even though I was going to plead guilty (and did), believe me, it makes one think long and hard :(.

As to the cop, I've turned over the perjury issue to the DA and AG. Outta my hands now.

I know some of you think that as an advocate for my client I give a side that favors his case or that I cop bash. One of my strong points as a criminal defense attorney is that I earnestly play devil's advocate in my own cases. Often I am more critical in this analysis than the prosecutor. It has served me well and I have enjoyed a modicum of success largely because I am so critical of my own clients. In this particular case, I am just appalled at the outcome...not because I lost but because it just ain't right what happened to my guy.

Even tho I had 4 of the 5 charges thrown out, my client now has a DUI conviction. Not the end of the world but that entails a $950 fine, requirement to maintain assigned risk insurance for the next three years at $150/mo, required to attend 4 week course on alcohol safety, license suspension for 90 days, 48 hours jail time (suspended) and 2 years unsupervised probabtion. Qiute a pinch for a "bogus" DUI.

Condolences should go out to your client...and the judicial system in this case. I'm all against drunk driving. But to get convicted of a bogus DUI charge stinks to high heaven. Our American system of justice sounds great, until you get rooked by some bogus charge. I'd be absolutely furious if I were your client.

Dueller, I'd want someone like you on my side if the need ever arises. BTW, you had a thread sometime back about a teenager (was it the son of someone who worked in your wife's restaurant?) that wasn't "justice" as most would expect either...how'd that one turn out?

ps: Ya can't win them all, don't beat yourself up over what you have no control over imo.

Everything thrown out except for the speeding. Pled him guilty to 70 in a 60. Agreed not to sue the city.

Cop A was fired last week...indicted for perjury. (Not on my case but they are reopening to look at my complaint again).
