Colt police positive special

My brother in law just inherited a Colt police positive special in 32-20. He tells me now he has to register in with the state of PA. Being new to PA, I did a quick search, and I don't see that anywhere o the rule book. Maybe he is confused with transferring it from the deceased to him. What say ye brain trust?

That's what I told him, but he is being a wooos. He says you must register a HG in PA. I say they haven't made the 32-20 since the 40's so it is a curio.

I have sold a handgun to a Philly cop while I was a PA resident and I've bought a handgun in PA as a VA resident. No registration.

Found this on a PA-specific gun board...
(c) Duty of other persons.—Any person who is not a licensed importer, manufacturer or dealer and who desires to sell or transfer a firearm to another unlicensed person shall do so only upon the place of business of a licensed importer, manufacturer, dealer or county sheriff’s office, the latter of whom shall follow the procedure set forth in this section as if he were the seller of the firearm. The provisions of this section shall not apply to transfers between spouses or to transfers between a parent and child or to transfers between grandparent and grandchild.

After all your comments and a few from other gun boards I post on, I have convinced him to just go to the lawyers office who is the executor of the estate and pick the damn thing up. Take it home and put it in the safe...done.

Register it in the State of Pa?

He has to transfer it into his name as per federal law and clear an insta-check.

I don't know if a gun made in the 40s is an antique. I thought that it has to be at least 75 years old for that.

Pre 1898 is Antique...anything over 50 years is a Curio & Relic...it alos has to have a greater value then a contemporary model that is comparable. Then there is the specific C&R list.

From there each state has its own regs.

I have people in my shop all the time asking me about registering a gun. It takes a while to explain that it doesn't mean what they think.
That PA provision is curious, do you know if it is in the State Laws and Published Ordinances?

I'm no handgun guy but others here should know. I think anywhere from $250 to $500 depending on condition.

I'll check in the book tomorrow when I get to the shop but I'm thinking that ruling applies to PA citizens rather than PA FFL holders.
Sounds like easy money for a licensee; I get $15 for internet based firearm transfers (5 minutews of my time). If I got that for my share of every private transfer in AR .......
Nah, I have enough to do as it is.
