Question Sales tax question - logistics...

Retail company is in Idaho.

Said Co. sells product to customer - who *lives* in Hawaii.

Customer wants to have product shipped to *California*, where friend will ship (large, heavy) product FOR FREE to Hawaii.

Product is made in & *ships* from California

Here's the question: Will customer be required to pay CA sales tax?


Does anyone know for 100% certain what the answer is?

Wish I could tell you for sure, but I am 99% sure that if a product is shipped out of California, sales tax will be due. I know that when buying from the tire rack, (which is based out of the mid-west somewhere) if the tires are shipped from Cal than I am always charged tax. Most of the time they are shipped from Nevada and there is no tax.

CA customers pay sales tax when it's collected. That should effectively answer your question.

The rules of the state are basically that if the sale is made out of state and there is no branch of the same company in CA (like a Macy's), then they are not required to collect sales tax on a sale shipped to CA. However, we are supposed to send the tax in when it comes time to file our st. income tax forms.

When my wife worked for Macy's in NV and a CA customer did an online or phone order to her store and had a CA address, they collected sales tax on the sale at the prevailing CA county rate IF the order was shipped to CA, not just billed. To a NV resident, they collected NV rates. To some states, they collected nothing. Sales to CA were common, I don't know why.

If they came in and bought the present and had a CA address on their charge acc't, they were charged NV rates.

That sounds correct. In this case the product is made in Cal, shipped from Cal and is being shipped to an address in Cal. I cant see how Cal taxes would not be due.
