Of course. That's why we still have them. I forget the case, but the ruling said as long as there's some system, not just pulling over random or every single car, it's permissible. It has to be something like every fifth car or those with odd last numbers on their license plates, just not random and just not every car. I don't know why this hasn't escalated to total car searches too. It did for a while in a DC neighborhood, but it got quashed.

Sure. And they frequently get the law wrong, usually for all the "right" reasons. Eleven states still consider DUI checkpoints unconstitutional.

Public intoxication is also illegal. How about an officer entering your favorite restaurant and breathalysing you as you finish your second glass of cabernet?

Why not a roadside checkpoint to see if your seat belts are fastened? How about a checkpoint for emissions? Why not a random checkpoint to look for everyone with outstanding warrants? Papers, please!

It's not OK to trample the civil rights of a population just because they are not targeting YOU.

Because of all the things you listed, drunk drivers kill other people so much more frequently, it's no contest. Someone tipsy in a restaurant isn't a death threat to innocent others.

I have absolutely no problem with DUI checkpoints. I'd be happy to see more of them.

It doesn't matter at all. Effectiveness or even necessity are poor reasons to defy the Bill of Rights. Besides, are you aware of the impact DUI checkpoints have had on the rate of DUI related accidents? I didn't think so. I know, I know... "If even one life is spared..."

The Bill of Rights guarantees us to be free from warrantless search and seizure. It doesn't say that citizens will be free from warrantless search and seizure "unless you're really not a nice person."

If you don't like it, AMEND THE CONSTITUTION! All this Oprah style hand wringing makes me want to puke.

Hey JYL, since you're a law-abiding citizen, I suppose you'd always consent to police searches of your car and house too, eh? They should confiscate your guns too, since it might save a life if all guns were banned.

I want a checkpoint to look for parents exposing their children to second hand smoke in their cars. I don't smoke so it won't bother me. Besides, stopping second hand smoke in cars will save more lives than all the DUI checkpoints.

I have a real hard time being randomly stopped and harrassed by ANY checkpoint--be it DUI, "safety check", aggressive driving or whatever label they want to use--the one which just started locally is "TACT"--targeting aggressive cars and trucks--wow sounds impressive.

All are excuses for cops to intrude into my personal life. I don't want to hear the "if you aren't doing anything illegal, then you have nothing to fear", because the fact is I AM NOT doing anything illegal so I shouldn't be hassled.
