Ballsy Burglar signs for FedEx

Just saw on the news.

Link

Guys house gets broken into.

Golf clubs and a couple of flat screens taken.

Homeowner had a new TV on order and calls FedEx to track it.

They say it was delivered, the day of the burglary.

Burglar signed for it and took it.

Now the owners stuck in a catch 22.

FedEx says “We feel bad for the homeowner, but we fulfilled our obligations as a transportation company,”.

Understandable.

Guys homeowners won't pony up claiming the TV never entered the house so was not covered.

Bummer.

Why? It's a private residence. You knock on the door, someone answers you're going to assume they are there legitimately.

Well, he never received it. Claim with the credit card company and let fedex and the vendor hash it out. If that does not do the trick, small claims court for the both of them. They will settle.

There are different levels of service with package delivery people here.

For Ground (non priority) items they can leave it at your front door in plain sight without a signature.

Think of the inefficiency of a delivery driver, on a schedule, making hundreds of stops a day, having to ask for ID for every signature.

Yeah it's weird. I'm gonna give the delivery service a pass on this one. Homeowners insurance is another matter. How do they know the package never made it into the house? I guess it would be hard to prove it did so who has the burden in this situation?

It would seem to me that it would fall onto the delivery company to assure the delivery. The guy that paid for it didn't get it. The legal beagles know more about the statutory requirements. But for FEDEX or the vendor to have to go to small claims court, well it would be cheaper to just pay the guy for the TV. Was the delivery insured?
