Lawyers: Anybody have a Blank Will Form?
Like the title says, I am after the simplest of will forms for my brother. No dependents. No spouse. No property. Very few assets - just a bit of cash etc in bank. I will undoubtedly be the executor.
He has weeks & is virtually bedridden. Long story but he is now staying with us until the hospital is necessary. I am trying to convince him to do a simple will to save the fees/hassle of dying without one. Taking him out to a lawyer will not happen. Even having someone come in would be difficult. He is argumentative to say the least. Home Care med people should start descending here tomorrow. I know a lawyer should be consulted & will be but for the purpose of a plain, simple will for a difficult, dying person, hassle-free is best . . . Ian

I'm no lawyer but I think one can be purchased at a good stationary store for less than $10.

We knew he was getting rough but when I picked him up Thursday from his boarding house . . .
My wife is going to stop at an office supply tomorrow after work. I just need something that he can easily fill in the blanks by himself. Time is of the essence - as they say. Ian

If he doesn't have any property, and you want to keep it simple, why does he need a will? If he wants to keep it simple, just put your name on all his bank accounts as a joint account. When he passes, you can simply withdraw the money. |

Not possible. The branch will want to see him sign to make it joint. I did that with my mother so I know their requirements. He is not mobile now.

I couldn't find any online when I needed a quick will, so I spent a few bucks at LegalZoom.com

I'm an attorney and I do wills, among my other talents. Simple wills are just that: simple. Can be as simple as writing out on a sheet of paper what you own and who you want it to go to. I also spend a lot of time, and client's money, trying to fix simple wills that people do themselves and screw up.
In your brother's case I would try the will forms you can find either at one of the online places like legalzoom.com or at a local office supply form. The most important thing you need to determine is how many witnesses you need to verify your brother's signature on the will. It varies from state to state and obviously country to country. Call any local law office and they should be willing to tell you. This is not legal advice, simply my thoughts being typed out.

If you need a quick will done right by a California attorney, PM me. I know one in particular that will draft a document with information he gets over the phone. You will still need to have the document notarized and witnessed by two witnesses. You can get a traveling notary to notarize.

Put everything of value in a trust, then make him the Trustee and you the second trustee.
When he passes, everything in the trust stays the same but with a new trustee. No probate, no death taxes and so on. Cost me $1000 and worth every penny.

Thanks all. I cobbled something together from another will. I gave/read it to him. We will see. Did I mention that he is mildly paranoid too? Always scary when you see how much control you give the executor.
