The man who shot and killed a suspected burglar who broke into his mother's South Shore residence on Monday apparently struggled with the man for a short time before getting hold of a gun and pulling the trigger, Chicago police said this morning.

Maurice Smith, 45, of the 2900 block of East 81st Place, was taken to Northwestern Memorial Hospital in critical condition but was pronounced dead at 5:30 p.m., according to a spokesman for the Cook County medical examiner's office.

Smith and another unknown suspect were attempting to burglarize the apartment in the 7100 block of South Coles Avenue about 11 a.m. when the man who lives there was awakened by sounds from the break-in, police said.

That man, in his early 20s, struggled, apparently fought with Smith, retrieved a gun and shot him, police said.

The other suspect fled the scene.

The resident has not been charged with any crime as of this morning.

Well, the break-in was not supposed to happen, they were just walking by, checking door locks, and then this crazed homeowner went bezerk and tusseled and tumbled and got the gun, and then just shot this guy point blank, oh my oh my, another thug gone to another place. This owner should get the Mayor Daly award for cleaning up the neighborhood.

It's not known what kind of gun the guy had (handguns and some "assault" weapons are banned FWIK, but I think the CPD will probably leave the guy alone.

Wonder how hard they are looking for the second guy that got away.

A wrongful death lawsuit is greatly prefered to a lawsuit by a criminal scumbag in a wheelchair looking for a lifetime of free health care. If your going to shoot em', kill em'.

Always wondered how a wrongful death suit works. Why is it wrongful, if the offender was the instigator? Can you counter sue to get them to go to h3ll and disappear?

The homeowner will not be charged and his weapon will not be confiscated. Daley does not want to hand the NRA or Alan Gura a case that can be used to easily defeat Chicago's gun laws, and a case of a homeowner shooting and killing an intruder would be just that case.

in nj...he would be in jail, i am pretty sure that we have to retreat unless we are cornered...even then it would be jail somehow

Were the burglars running away when the off duty cop shot at them? Is there a suit in the future? Will the cop be charged with anything? What would average-Joe homeowner be charged with in the same situ?

An off-duty suburban police officer shot and wounded one of two intruders who broke into his South Chicago home tonight, authorities said.

The two offenders broke into the rear of the Hazel Crest police officer's home in the 8500 block of South Phillips Avenue at about 7:20 p.m., Chicago police said in a statement.

The officer opened fire in the direction of the two offenders, striking one of them, police said. One of the offenders was also armed with a handgun.

Both men fled, but were apprehended a block away on Essex Avenue. The wounded offender was taken to Advocate Christ Medical Center in Oak Lawn, where his condition was unknown. The second offender was taken to Calumet Area headquarters for questioning, police said.
