NAPLES, Fla - A Christmas controversy in Naples. Code Enforcement wants one local business to take down its Santa Claus.

The Back Store owner James Koss says Code Enforcement told him the board his Santa is on is too much like the inversion tables he sells inside and that's a violation.

"I had my handyman, out of pine, build a teeter totter," says Koss.

Koss says Code Enforcement told him Santa has to be upright.

"If santa is head down its code violation but if he's up its ok," says Koss. "it's a grey area."

After days of disputing, the city still wants santa down. Code Enforcement stopped by The Back Store, but workers say when the officers heard Wink News was coming to film the action, they took off.

"I believe they think it's very important but they'd like to do it when nobody can see them," says The Back Store employee, Paul Novak.

Koss says Santa is here to stay

"If someone puts out Santa, if it's a business or a family and it attracts attention is there something wrong with that?" says Koss.

Our calls to the manager of Code Enforcment have gone unreturned.
