Re-submit I-9 employement eligibilty?

Have any of you ever had to re-submit an I-9 form? They're making all of us do that here at my work - you have to bring in your birth cert, passport, etc. It almost sounds like an HR job security exercise. I've been here 12 years and never seen this before.

I've never heard of an I-9.

And yes, we all have endured stupid excercises where HR tries to justify its worth.

myamoto1 02-22-2010 09:53 AM

Yup, we are going through that right now. Had to fill out some on-line form, then bring in "proof of life" to the HR office...

It is just part of the bureaucrat full employment act. Shuffle that paper!

just check "OTHER" and you will be fine.

Blame the current political environment. ICE is a lot more active that it was 10 years ago. On the advice of my attorney I had to put all my employees through it last year. The inconvenience and disruption is a small price to pay to avoid the fines and general government harassment that result from ICE finding a mistake or a non-compliance situation.
Or they could have lost all the records.

Could be just HR exercise.
Could be somebody lost some forms.

No reason to do them now if you completed one at the time of hire.
According to the form, the I-9 is done at the time of hire and there is no requirement to re verify except on employees who hold a green-card.

Some employers have been known to use the I-9 as a means of discriminating or obtaining information that they are not allowed to ask due to privacy laws in some states.

According to the form instructions, "Employers CANNOT specify which document(s) they will accept from an employee." Review the I-9 form and decide what ID you would like to bring in. Don't let them decide for you.

Also, if your company is a Federal Contractor, as of Sep 2009 they were supposed to be running everyone's info through E-Verify.

Part of Homeland Security.

we had to do it as well, everybody

campbellcj 02-22-2010 09:01 PM

Unless something has changed in your status or information such as a temporary visa becoming permanent or a name change, or HR has lost the form, this should never be necessary as far as I know. I bet what happened is they were missing the forms for certain employees and decided to re-do all of them to avoid any claims of discrimination or profiling.

It's all heading towards electronic filing (E-Verify) which is already required for anyone engaged in contracts with the federal government.

Someone lost the original records.

It's just proof you didn't come over the border under a pickup truck.

No, it is an incrased push. The employers need to submit electronic records now. If they didn't have the records or if they are over a certain age, they need to resubmit.

gr8fl4porsche 02-23-2010 04:19 AM

We had to redo all of ours as well.

fxeditor 02-23-2010 01:24 PM

For some odd reason my union (Motion Picture Editors Guild) makes us do it every 3 years!

lendaddy 02-23-2010 01:30 PM

I-9 forms are nothing more than eyewash, employers are not required or expected (and rightfully so) to be detectives. Fake I.D.'s fill out I-9 forms just as well as legit ones. It's just standard CYA stuff, "hey, they had proper ID."

berettafan 02-23-2010 06:04 PM

Penalty for missing I9 is something like $10k PER!

That's one of those fines that almost never get imposed, sort of like the labor law posters that "must be posted in employee common areas".

I don't doubt that they occasionally get enforced but I imagine it's the type of charge that only sees the light of day when the prosecuting authority wants to double or triple dip a douchebag offender.

Either way the I-9 is a joke of a form, which is really my only point here.
