someone is trying to scam my brother..fake hit/run?

unbelievable!!

he and his special lady friend went to santa fe recently. they stopped at some killer burger joint. he said he went in to get a few burgers togo. she waited outside with the dogs..and he went in. he said, two people were giving him stinkeye the second he went in..he figured they were racist and blew them off. he paid, got food and left. the people followed him out and continued with the dirty looks. they drove away.

today, he gets a letter stating a couple filed a hit and run on him, and he should contact his insurance company to pay the damages. he checked and there is an actual accident report against him.. his truck has zero damage..

any suggestions?

there is no defense against a fake claim right?? a new scam?

He has a witness. Once the police hear his girlfriend's side of the story, it will be he said/she said. They won't pursue it further. The insurance company will do the same thing.

The burdon of proof is on the person making the claim. No evidence, no independant witness no case.

From a recent experience I learned that insurance investigators have a way of tearing up a witness. If there is the slightest inconsistency in their story the invetigators will jump on it. Remember insurance companies investigate false claims all the time. Chances are the perps making the false claim are amatures. If they weren't they'd be going for the big fish like a toe nail in their BigMac or something like that.

take pictures of his car immediately just in case they claim your brother got the damage fixed already. If they claim he hit them and there's no damage to your brothers car it seems like this would be very easy to refute. But then again maybe i am just naive.

This is in Santa Fe? Liberal Santa Fe? Well, as lib as AZ gets.

I know what I'd do, reverse the claim (or claim the reverse). That'll keep 'em busy.

he's a pretty good dude. he doesnt want to pull his cop card, and "release the kraken"..i would have already called SF PD and had them do a drive by to look for paint transfer and damage..but i'm a dick and would abuse my power
