can someone explain the california 10 day handgun wait to me?
i called my FFL guy. i asked him (kinda timidly actually) , "am i all clear?"
he said he found out on the very first day that i was a certified law abiding citizen. what?!! then what are the other 9 days for? i get the new hardware on saturday! i also think my brother got me some SWAT approved goodies..my grapevine is very loose lipped..shhh. i dont tell my mom anything. |
It is for making the process difficult thus disuading you from starting the process...

I think the rationale is to let tempers cool - no "Hey Joe" moments - getting mad, going to the gun store, and blowing her away that day. Secondarily to allow time for background checking, perhaps the checks used to take longer.
I'm not convinced the waiting period has much benefit. Then again, I'm also not able to think of any time I actually needed to have a handgun within 10 days or else. So basically I don't care (or didn't when I lived in CA). |
I always looked at it as giving you the time to adequately stalk your intended victim, get very clear about his/her habits and better plan the exact right time/place to take them out, how and where to dispose of the body and make your getaway to Mexico.

Normally TX is 10-15 minute wait while they check.
My last FFL transfer the guy tells me it got flagged and to call in a few days. If they don't hear back in 5 then I can come get it. He said it can happen when you have a common name or it may have been that I was not born state side. |

10 day waiting period for all firearms purchases in CA, not just handguns.
Frequently Asked Questions - Public - Bureau of Firearms - California Dept. of Justice - Office of the Attorney General But as said before, it's pointless after you already own a gun. But, how would they verify you're already a gun owner without registering every gun purchased and making that registration available to all FFLs in the state? I guess that would make the waiting period the lesser of two evils. |

And this would almost be amusing, if it wasn't so stupid: I have a C&R FFL. I can order a rifle from any number of distributors and have it shipped directly to my house. But if I went to buy the same rifle at Big 5, I would have to wait 10 days. |

I had an English guy visiting me about 5 years ago. I took him out to the range and he fired a gun for the first time. I then took him to a local sporting goods store. We looked over a bunch of things. He asked how hard it was to buy one? I put down a credit card and proceeded to purchase one. Walked out 10-15 minutes later and we went back to the range and broke it in...

Ok, I'll play this game. Buy a gun. Wait ten days, get the gun. So what is the problem here? Lets move on to something really important.

Beyond the 10 day wait thing, as I recall there is also a no more than 1 purchase every 30 days limit. (That one may only pertain to handguns, but it is silly regardless.)
These rules cannot possibly have a benefit to society or any impact on true criminal sorts. All I can figure is they exist to penalize and discourage citizens, dealers and manufacturers. But then we are attempting to apply actual logic to politicians' actions that defy normal logic. |

The way this BS started was with the Brady Law in 1994. It contained a federal five day wait, but also set up the National Instant Check System (NICS). The provision there was that once a state had the NICS online, they no longer had to abide by the five day wait. VA was the first state to have the NICS up and running and, IIRC, it was even before the five day federal wait went into effect. So VA never had to go by the federal waiting period. Of course, that outraged some of the anti's in the northern VA suburbs, so Arlington and Fairfax Counties and Alexandria City passed their own local waiting periods. This, of course, just drove business to Prince William and other counties with no waits and where buying a gun was cash and carry. VA later passed a state preemption law that did away with this BS. I've never lived anywhere that had a wait since then, so I imagine those places that still have them passed them around the time the federal law was to sunset about six yrs. ago.
In AZ they don't even have to runs a NICS check anymore if you have a CCW. You just hand them your license for them to verify the info you put on the 4473 and you walk out with the gun. If you don't have a CCW, it might take as long as 15 min. before you can leave and begin your crime spree. I bought a SIG at Cabela's and it was almost as fast as buying a pack of cigarettes. |

A waiting period has never stopped any crime. Anyone who is mad enough to shoot someone will certainly get that mad again once they have the gun. And why would anyone bother submitting to a background check and buy a gun in a store, which they plan to use in a crime unless they also planned to die in the attack? I don't really mind the background checks, as they sometimes weed out the extremely stupid criminals, but it's folly to think they prevent anyone from getting a gun who really wants one.
