LAWYER TIME need a defense.

once a upon a time, a certain person was hauling azz in a car w/a trailer w/his young kid(under 18) thru a po-dunk town in kalif..(not me mind you). on his 1st day driving with kid was caught by CHP for skimming a corner of a double yellow and 20MPH over. got a stern warning.


a few days later coming back, does EXACT same thing. skims corner, 20mph over limit and YES THE SAME COPS BUST HIM! handcuff him, take kid, take his azz to jail.


wasnt drunk, no drugs, no weapons.



charge is "RECKLESS CHILD ENDANGERMENT!"



possible penalties ARE UNGODLY STIFF AND NASTY!


like 2 years in prison, possible kid grabbed by CPS, has a felony record which would preclude firearms etc.



really really REALLY NASTY STUFF!



cops lied thru their teeth on report. aka making this into a MOUNTAIN OF POO!



was not in the other lane, just had left front tire on double yellow line aka straddling it.



what is the defense here??????????? is there a defense?



this will be ugly spendy, ugly time consuming, and POSSIBLE DOWNRIGHT "meet big louie" UGLY time!

Even discounting your illiterate account of it, this story does not make any sense. Someone is going to prison for crossing a double yellow line? No accident, no one injured, no DUI, no nothing??

Pick any lawyer on earth, pal... Even one who's recently been shot in the head should be able to win this one. The lawyers I know get people off for actually killing people. It would be like using a machine gun on a groundhog.

I would say his best defense would have been to be obeying the speed limits while hauling a trailer and be more aware of his vehicle placement in corners.

Failing that, he should have listened to the nice officers, taken their advice regarding speed and vehicle placement.

I'm sorry, but I think if this guy was not your friend and had been driving 20 over in your neighborhood with a trailer while clipping the center line you would be after his hide, regardless of the presence of a minor child.

KA can't afford to be jailing people over this kind of stuff. They're releasing murderers and rapists due to overcrowding and budget cuts. They'll just want the fine money. Get a lawyer to knock it down to something minor, do the online traffic school, never see points and tell him to pay attention next time. Crossing a double yellow line at 20 over is not necessarily dangerous. But it is stupid after getting a warning from a cop in a state that is aching for fine revenue.

+1. I trailer all the time. 20 over is lunacy (especially if he can't stay inside the lines) and reckless endangerment of his kid and everyone on the road with him. Your friend deserves to have the book thrown at him. He won't see the inside of a cell, but he needs to stop driving like an assclown.

That's not a fair comparison, Denis. Your dad is a legend and used to office with Ron Meshbesher, Jack Norby, and who knows who all else. If those guys couldn't get you off Daniel Webster couldn't either.

Charles, my advice is to find a lawyer who you can communicate with well and who also speaks English. Shouldn't be too hard to take care of. Don't you have a neighbor or a buddy or someone who can handle it?

yes he has hired the "pros from dover" , found out DA's plea down, is waving the carrot of pleading guilty to "CHILD ABUSE!" and a ton of classes including anger mgmt, parental care, and assorted others, but no class re: defensive driving(go figure), and of course some obscene fine.


the child abuse charge plea down is also a felony.



basically if he fights it and ends up teets up......................2 years! YIKES! and a FELON!
