Christie frees man in gun case

New Jersey Gov. Chris Christie gave the Aitken family all they wanted for Christmas Monday.

Christie signed a letter ordering Brian Aitken, a New Jersey man sentenced to seven years in jail for having weapons he legally purchased in Colorado, to be released from Mid-State Correctional Facility as soon as possible.

Aitken, 27, was sentenced in August to seven years after a January 2009 arrest at his parent's home in Mount Laurel, Burlington County. Aitken's mother called the police on him after he was distraught over a custody issue and police found handguns, hollow point bullets, and high capacity magazines in a box in the trunk of his car.

Aitken claimed he was protected under a state exemption because he was moving from Mount Laurel to Hoboken at the time. A Burlington County judge refused to allow the jury to see the exemptions, claiming Aitken's defense team did not present enough evidence during the trial to show he was moving.

Aitken's father, Larry, could barely speak when reached Monday, but thanked "Governor Chris Chringle."

"From my family to yours, Governor, have a wonderful Christmas," Aitken said.

"We're overjoyed," Aitken's fiancee, Jenna Bostock, said Monday evening. "I can't believe he is going to be home for Christmas."


Christie, who had earlier said he would make a decision on the much-debated Aitken case by Christmas, signed the commutation around 4:30 p.m. At around 6 p.m., Bostock said she was waiting on a phone call from Aitken from Mid State Correctional Facility in Wrightstown so she could tell him he would be coming home.


"I can't wait to hear his reaction when I get to tell him," Bostock said.


Aitken, an entrepreneur and media consultant, has been jailed since he was sentenced to seven years in prison on Aug. 27.


Aitken was arrested on Jan. 2, 2009, when he muttered to his mother life wasn't worth living, then left her home in Mount Laurel. She called police, who found two handguns, both locked and unloaded, and ammunition in the trunk of his car.


Aitken argued he was in the process of moving to Hoboken, which would exempt him from a weapon-registration law. However, state Superior Court Judge James Morley did not allow the argument in trial this year. Aitken, a graduate student with no prior record, was convicted and then sent off to prison in August.


Christie later declined to reappoint Morley because of an unrelated case.


Aitken's case garnered a large following among the media and gun-rights advocates.


Bostock said she has nearly made a full-time job out of posting information and eliciting support on a "Free Brian Aitken" Facebook page.


"It has been really, really hard and now all of our hard work has paid off and it feels amazing that the injustice was corrected," Bostock said.


A spokesman for the Burlington County Prosecutor's Office declined to comment about the matter Monday.


Aitken's father, Larry Aitken, said his son's attorney is still fighting to have the conviction reversed.


The commutation Monday only dismisses the remainder of the prison sentence. Larry Aitken said the family will keep fighting until his son's name is cleared. Larry Aitken said he personally wrote the governor a letter asking for clemency over the summer.


"I'm still stunned," Larry Aitken said Monday evening. "It's kind of like the clock just ran out. The game is over and we won."


According to the commutation order, Aitken is ordered to be released from jail as "soon as administratively possible."


Amid her giddiness over Aitken's imminent release, Bostock also thought Monday evening of a few things she needed to get done.


Aitken's suit would need to be dry cleaned before she picked him up from prison.


And one other thing.


"Now I have to go find a Christmas present," she said.

Why wasn't he fully pardoned? His family will be bankrupted trying to clear his name. And he's still a convicted felon until then, which means he can't replace the guns the state confiscated from him. A tragedy all around. Too bad that judge doesn't have to serve the remainder of Aitken's sentence. I'm in NJ now and cannot wait to get back free America in AZ.

Harvey Cedars on LBI. I think this township has eight full time cops for the 300 residents who brave the winter here. In fairness, I've never dealt with a NJ cop who wasn't totally cool. But the gun laws and culture scare the hell out of me. I've trampled on the car carry laws here many times before I realized what a police state it is.

you can always take the rental car up north into the woods and chase deer!


just make sure you have insurance in place on the rental car as YOU WILL FIND DEER! and very possibly if not 100% possibly they will land on your HOOD!


ask me how i know! the only other place i have ever seen so many damn deer is monticello utah above moab.



please take pics of the hotel bar band.................it just might be the same guy,singing the hip tone crazzzy tunes of yesteryear,that we all know and love.


his rendition of deep purples "smoke on the water" and the lokals out for a night on the town,dancing to this, had us damn near peeing our pants/crying with laughter.



if i asked my honey to go to the lokal holiday inn for a dancing night on the town..............she would SHOOT ME!

Rick, I have no idea what the answer to your question is, but I would guess that the way the way the governor did it, gets the man out of jail the quickest (home for Xmas) and that he can then do the pardon thing, which may take longer administratively.

Just a guess.

Funny thing is, as of the latest poll, Christies approval rating is below 45%.

Guess they must have polled mostly Govt workers and teachers..
