tabs, this post is for you: spoons in vegas

so, the family and i are spending a week in vegas at one of the big casinos. i usually travel with my .40SW spoon. what are the rules and can i take it to my room and lock it in the safe?

NV no longer recognizes UT CCW permits. You cannot CCW in NV and open carry in a casino will get you taken down in a hurry. You can take it to your room and you can carry it in your car. I have a NV permit, so I'm covered now. You should try to do a NV CCW class while you're there, so you'll be covered next time.

well, i don't want to conceal carry, nor do i want to carry openly in the casino! however, i do like having my spoon with me when traveling. so, if i can take it in the car across state lines, pack it, unloaded, in my luggage when i get there, and store it in the safe when i am out of the room, i am happy.

You can keep it loaded and in your center console in NV. Just throw it in your bag for the walk to your hotel room and don't make a scene out of unloading it in the parking garage where there are ubiquitous cameras. I don't know about car carry in UT, but I have a UT CCW too, so I'm covered there as well.

in utah, because my spoon is single action, it can have a clip in it, as long as there isn't a round in the chamber, and it isn't considered loaded because it takes more than two actions to fire it.

If you follow Rick's advice, I would think you have made every reasonable effort, and in good faith, to comply with the various laws, various jurisdictions and even with common sense. In turn, any judge (heaven forbid anything were to happen) would have respect and sympathy for such a responsible American gun owner.

No, really. You either do all that stuff or don't take the thing with you. Simple as that. If you choose to take it, you're accepting the potential to be stood before a judge on a gun charge. You are also accepting and acknowledging that the judge may not be sympathetic. You may be forced (heaven forbid) to demonstrate that you had decided that risking your personal safety and the safety of your family warranted also taking the lesser, but very real, risk of sustaining the wrath of an unsympathetic judge.

that is the point: i don't want to do anything that would put me in front of a judge. i want to take the gun and do it legally. get it?

As you know Nevada is an Open Carry State, legally you can Open Carry anywhere except where properly posted (usually government buildings), in a casino, being a private property, you will be ask to put it back in the car, if you decline you can/will be charged with trespass. You can have the gun in your car but not in your person, a gun in a backpack may (has been) considered conceal carry, be aware that North Las Vegas and Boulder City have some 'funny' local ordinances that even if they have been sunset by Nevada laws local PD may give you a hard time (less and less often). I get it. I thought you wanted to brandish a loaded, illegal weapon in a threatening manner in a public place in the presence of your own minor children while under the influence of alcohol. My mistake.

do they make a distinction between having an unloaded weapon in luggage (a backpack for instance) vs. a loaded weapon?

in utah, a gun with no ammunition in it is not a concealed weapon.

If you want to be 100% safe, you can break it down, put it in a locked container in your trunk with the ammo separate. But that doesn't do you any good if you get stranded in the middle of the desert, which has happened to me twice in NV in the last 18 mos. Boulder City is a place you pretty much have to pass through if you're coming from AZ. But coming from UT, I don't see how you'd go there unless you really wanted to see Hoover Dam. And you want to stay out of North Las Vegas under all circumstances. BTW, why would a cop ever search your trunk? Never ever consent to such a thing. I got pulled over in NV over Thanksgiving and handed the cop my DL and NV CCW. I was armed at the time and he didn't care at all, was totally cool about it. He didn't run my CCW or ask to see the gun or tell me to keep my hands where he could see them.

Vegas is a small place. I was at SHOT yesterday among 50,000 attendees and ran into Jordi there.

so, what i am getting from the above, i can have the gun as long as it stays in my car or in a private residence..... it gets sticky when i take it onto private property, like the casino.
