Here's Your Sign!

Reuter's News just posted an article about a guy in Oregon driving a 2005 BMW at high speed on I-5. He was pulled over by the police for doing 118 mph. He was shooting video of the cop as he walked up to his car. Said he was shooting his speedometer and wanted to post the "event", including the police stop, on YouTube.

They discovered the video showed him doing 140 mph.

He spent the night in jail....

Here's your sign!

They took his car, too.

I wonder if the video he took can be used as evidence against him or if the police will rely on their own evidence.
Also interesting to ponder:
Assume it is decided that the vid can't be used against him, but by now everyone knows it shows him going 140. Can an investigator ask him if he was going 140 mph? Obviously if he says no he's a liar, but if he says yes can he be charged with 140?? If it goes to court, can the prosecutor ask if he was going 140 before a judge?
This guy put himself and the law in an interesting position.

Here's the report from the Oregonian:

about 2:45 p.m, Postlewait was entering I-5 from the Delaney Road on-ramp in South Salem when he saw a 2005 Black BMW M3 driving fast northbound on the freeway, according to Don Thomson, spokesman for the Marion County sheriff’s office.

The traffic was moderate but the area was experiencing 20-30 mph winds, with gusts reaching 50mph. The winds had left several tree branches in the roadway, creating driver hazards.

He clocked the BMW at 118 mph in the 55 mph zone, more than twice the speed limit. As he was stopping the vehicle, he could see that the driver was holding a small video camera, taking photos of the deputy’s traffic car, Thomson said.

The driver, Stanislav Bakanov, 30, of Keizer, admitted going between 90 and 100 mph, Thomson said.

When asked why he was driving so fast, he told Postlewait his explanation was going to sound stupid, but that he was making a video to post on YouTube. Bakanov then played back the video of his driving for the deputy. It contained footage of his speedometer with the needle pegged near the top of the dial. It also showed footage of Postlewait’s patrol car pulling Bakanov over. Bakanov had fashioned a mount on the windshield to hold the camera while he drove.

The camera was seized for evidence. The video will not be available to the media at this time, Thomson said.

Bakanov was arrested on an accusation of reckless driving, and taken to the Marion County jail. He was also cited for speeding, and his car was impounded. Bakanov’s driving record shows that this was his third speeding incident in the past year.

Some Advise For Him

Regarding the post by wdfifteen, I heard this quote somewhere but I don't remember where. It goes "I had the right to remain silent... I just didn't have the willpower".

Sounds like great advise, huh?

Do you think he'll profit from this advice?

This guy put himself and the law in an interesting position.
I am sure his lawyer will tell him to remain silent. If they ask a direct question, plead the 5th. Say nothing.

It is too late now, the entire world knows he is an idiot. And I have ZERO sympathy for the dumb ass.

10:1 this guy is completely shocked about being in jail. "But I was taping it for YouTube. It was just a stunt! Why did I get arrested?"

It was the comedian Ron White who said "at that time I had the right to remain silent, I just didn't have the ability".

The entire world is against him. No one will let him have a little fun. It is just because the cops are mean.

I've driven faster than that, but I sure as hell wasn't f*ing around with a video camera while doing it. Hands 10-2 and eyes forward thanks.

We Need To Thank Him

Ya gotta admit. He's been great for a little comedy relief in our otherwise dull and boring life (by his standards).

When's the last time you did jail time and lost your car due to a giant brain fart?

That's just a rhetorical question... no need to admit to anything.
