I know nothing about flying, but I have been in NYC where I would not let a hang glider stunt person fly between high rises due to the intense winds that blow between them at times.

I was in a sports bar having a late lunch 3 blocks from the site when it happened. As you may (or may not) remember, this was long after 9/11, but it all came back pretty quick. The sound it made, the screams, people running in both directions, and then the sirens and fast movers thru the streets got real intense. Brought back a lot of raw emotions.

Nuisance lawsuits like this are killing American entrepreneurs. I know of two projects that were abandoned due to fear of this kind of law suit. They would have created jobs and contributed to the economy. It's bad enough to worry about keeping the bills paid when you strike out on your own without having predators like this lawyer hovering ready to strike. I don't know what the answer is.

the answer is to make to make the losing plaintiff lawyer pay a percentage of the court fees, up to 110%, at the discretion of the judge, based upon the merit of the lawsuit.

At first blush it sounds like a good idea. Any idea why it isn't done that way now?

yep. for fear that those that cannot afford would not bring things to trial. however, i am not proposing that the party pay for the costs, but the lawyer. plus, the judge could rule that there was some merit, perhaps a lot of merit, in the lawsuit, and only bill the plaintiff lawyer a small percentage.

edit: i also think that the jury, if such is the case, should be allowed to punish the judge for hearing a lawsuit, with no merit, up to and including a fine of 110% the court costs for wasting their time and our taxpayer money.

In Canada if you lose you have to pay the court costs and all the defendants costs. We don't have (many) frivolous lawsuits, as the lawyers won't take on anything but a winner.

i believe it is the same in other countries, including germany. if wrong, i am sure someone will correct me.

Because then people wouldn't sue. In addition these types of cases are taken on a contingent basis. If the plaintiff had to pay out of pocket many of these cases would never be brought.

I would bet a lawyer approached Lydle's wife to bring the suit. I doubt The3 wife approached them first.
