I'm not yet worried about it. I know USAA will get in the fight for me if it becomes necessary. What I don't want to have happen is for the driver to claim he can't pay because the repair is too expensive or unreasonable. And his friend surely won't want to take the insurance bite for the accident. So he'll ask the driver to pay out of pocket.

Conversely, and consequently, if my car is uninsured, it remains uninsured if I lend it to you. You're insurance on some other vehicle that you own would not cover it. Otherwise, I could get insurance on one cheap-ass Ford Taurus and go drive any car I feel like and be covered. Rental cars are a completely different situation. Special exception on policy. Doubt me? Want to bet how this shakes-out? Contact your insurance company. That's what you pay them for. They'll get to the real insurer faster than you can chat about it on the internet. If you were not at fault, (and it sounds like you were not at all), it does not effect your rates in any way. |
Ok, I'm startig to believe this guy's insurace is gonna balk. But hey, they may track the other guy's down for me, and he may even have Farmer's too. I got rear ended in DC once by a lady with USAA and that was real easy. I'm not gonna get excited about this for a while. I'll give Farmer's a day or two to give me a ruling.
|
Well, it just keeps getting better. Farmer's tracked down the owner of the truck, but cannot get hold of him because his voicemailbox is full. They can't find his address, but told me Infinity is his insurer. I called Infinity yesterday and opened up a claim. But they couldn't get hold of him either and then called today to say he did not renew his policy, which expired on 06/29/11. They don't know what else to do, but said they'd send me a denial letter.
So I called Farmer's again and they said they're secondary and will probably cover it now, since there's no primary. They need a copy of the denial letter from Infinity. Oh, this is so much fun. I hate everyone. |
what is the penalty for driving uninsured in AZ?
|
Nothing's ever simple and straightforward these days....more's the pity.

I've been harassed for not letting people drive my car. I will never ever let anybody drive my car, regardless if it's my Porsche or my Mazda 3. This thread is why.

So basically, he was out backing into people in an uninsured truck. If you understood how auto insurance works and demanded the insurance card for the truck at the scene of the accident, he would not have been able to produce it and you could have called the cops, who would have cited him for driving an uninsured vehicle. Now he, and the owner of the uninsured truck are off the hook and you have claim with your insurance company, complete with $1000 deductible. That sucks. I watched a very dumb and/or nervous female driver back a POS Ford Ranger into a new Ferrari 599 last night trying to parallel park. The Ranger was raised and the bottom of her bumper hit the slope of the hood on the 599. Pretty sickening thing to witness, it was like watching a baby get run over. People in PU trucks cannot see low sports cars behind them, end of story. You really have to be ready to back-up in those situations, the horn won't always save you. The horn on Paul's 356 works on and off, there have been some pucker moments in that car behind trucks and SUVs. |
Well, Farmer's said they would be secondary insurance, so this might work out ok for me.
|
I sure hope so. Farmers is the insurance co. of the driver?
|
Yes, the driver has Farmer's. It's not yet even established that the truck was uninsured; just that his Infinity policy had just expired. Could be he left them for someone else and is just very hard to get hold of. Driver admitted liability and sounded concerned for his buddy getting dinged for the claim. So hopefully, he'll help a little more in tracking the guy down.

Still in a holding pattern while the insurance companies chase down the owner of the truck whose vmbox is full and whose Infinity policy expired just before the accident. If this isn't resolved in week, I'm going with USAA and will front the deductible until they sort it out. I'm almost positive Farmer's will pay, but it might take a while.

Check with AZ state law (or your agent). The expiration date is not necessary the end of coverage. They are required to provide a grace period for renewal in some states.
Don't you know where the guy lives? |
Don't know where he lives, but USAA says they'll know by Monday. They're doing a plate search to get his VIN, which will then tell them who his insurer is.
|
guy made a biiiig mistake...
on a related matter, I almost got crunched an hour ago by some idiot kid who swung out of lane w/o looking to avoid some slow turning car in front of him. "Luckily" I was in the Subaru -- more luckily I quick-whipped the wheel over and avoided him. Glad there was no one in MY adjacent lane. The planet is covered with idiots. I hope you convince "your idiot" to be more careful and more honest next time. |
Ok, Farmer's has agreed to pay. They're sending me to one of their places for an estimate. How do I do this? I want to DIY this now and have a bumper lined up. I want to get $2200 for the estimate. Assuming the adjuster place they send me to is not a Porsche shop, what are the odds they get this number? I know the bumper cover costs $1300+ from Porsche. More than one paint shop I've asked has said $300-$400 for prep and paint. Figure a few hours labor and misc. parts and $2200 sounds about right, no?
|
Go to the best and most expensive body shops around to get estimates and then take those to the adjuster to show what it's going to cost.
