Getting back to the OP, yes I can't help but have pity for the woman. I don't know her story, and whether there might be more to it.

Let me ask just one simple question:

Do you have any proof?

The proof is debatable for anyone that did not see, smell or talk to her.

I ended up calling our broker and letting her know about the situation. It hasn't went any farther than that.

She just returned to the office, this time she managed not to slam her car door into the CFO's new benz and was able to pull her bag on wheels over the curb without too much effort. Maybe she has her $hit together and can finish the audit.

But here's my logic/reasoning. I am scared of the Calif Dept of Labor Relations. That is the agency that enforces WC laws and levies penalties. Sometime huge ones that put you out of business. I would avoid them at all costs. I was thinking along the lines of a more calibrated response. A neutral third party like State Fund is created as a backstop against insurance market irregularities. They can and would be happy to look over an audit and provide their opinion. You can use that to go back to the insurance broker, rather than call in the jack-booted thugs over at Dept. Labor, which is totally a nuclear option. Nothing is worth that. I'd rather intentionally pay too much rather than call them in. They screw everything up, for a very long time.

I think the acid test is whether the employees of State Fund work for a private entity or the state as civil service. I searched and they are civil service. It is confusing at best.

And the more I read, the more I would not want to be covered by them. However, that goes for most of the ins cos. I'm battling Allstate right now and they are the worst I've dealt with in my lifetime. But, it's not a WC case.

Milt, all I know for sure is that they scare me, and two of my friends, best friends, work for the dpt labor and edd.

Well the audits are done and she's gone. I'm glad she made the decision to show up sober, or at least from what I can tell she was.
