I wouldn't even talk to the guy about it. Go cut up the wood on your property and be done with it.

In Wa state, if it falls on your property, it is yours at the property line and the cleanup is on you unless the person knew that the tree was diseased or dangerous.

Trust me, I go through this scenario at least 4-6 times a year with my fencing. I have warned my neighbors of some diseased trees that I am worried about. Being the nice guy that I am I even put orange plastic tape around them. They have removed about 5 of them, they have a few to go.

Tornado beat my a$$ a few years ago, all the trees that took out the fences were my neighbors. I did file a claim with my insurance and billed them for all the hours I worked, tractor rental, gas, chainsaw sharpening etc......

I would not allow him on your property due to the liability issues and it's a good excuse for you to keep all the wood.

Tell him to go pack sand high and tight and to get his stinking tree off your property now before you contact his insurance company.

Or, you could continue letting him take advantage of your kindness and generocity and risk being a schmuck.

Telling him to pack would propably be the better option.

YES, I totally agree with dad911!

This is what I would do, knowing that you don't really like the guy...he's refused your initial deal, and, yes, you'll end up using your equipment, gas, etc. and you know full well that if he hurts himself on your property, he'll come after you. But, you want to come across as a respectful neighbour:

Tell him that since the tree is now "my problem", and that "I am concerned about possible further damage to my property and also about you possibly hurting yourself on my property, I will take care of it myself. And, although I'm not obligated to do so, as a good neighbour I'll give you 1/4 of the wood..split and stacked. I'll start tomorrow....where would you like me to place your firewood?"....(this is non-negotiable!)SmileWavy

I don't see how there is a liability if the neighbor enters the property with or without permission. If Fred gives him assistance or equipment, yes. If the guy steps in a gopher hole after someone says. "Watch out for the gopher holes," I think Fred is OK.

This country is so sue shy that it's afraid of its own shadow. The tide may turn as the wait for a court date can be years these days. Allstate is doing that to me right now, but I've got the time.

I think it Fell Friday during the day. Thursday , and Friday were 13 hour days for both of us. We discovered it Saturday Morning, and there is no way we slept through it falling, it is about 30 feet from our bedroom window. So, no, nobody heard it.
I appreciate your input guys. It is always good to bounce ideas/thoughts off this group, even oddjob :). It seems as though the majority of you guys feel the same way I do. My neighbor is an asshat.
I initially assumed that I would be cleaning up this tree myself , I think I am just going to stick to this plan. There a few very large branches that fell on his side. I'm just going to tell him to clean up his own yard, and I'll take care of what fell on my side. He will just have to learn to deal with it. The huge bottom portion of the tree, that neither one of us can saw through, or move, is fortunately , on his side of the line.
Of course , I went to get out all my tools tonight, and I promptly broke my best chain saw , and the back up won't start, damn ethanol. I dropped off all my chains to get sharpened, got a new carb on the way for the husky chain saw, and ordered parts from the stihl man, and I should be in business next week.
Have not seen , or heard from the neighbor for two days now.

sometimes peace with the neighbor just isn't worth it. sometimes a little war is the best way to get to peace. since letting my neighbor know that he was on notice for a little arse kicking if he didn't fk off, its been pretty peaceful around here. his wife and kids seem to love me, as he is a right bully. it got around the neighborhood really really fast, too.

This happened last Thursday night. It took me over 8 hrs to clean it up and a buddy (who I gave all the wood to) came over and helped for 4 hrs. The branch was over 36" at the base so I had to cut it up in chunks to get all the way thru. Dulled two chains while cutting.
