Patent question,,and one more

AFAIK a person can make a part for them selves that someone else holds a patent on. Right"
For myself, not for resale.
Correct ?

Also, basic engineering concepts such as levers pulleys, jack shafts are not even patent able, right?
The debate is, - Someone holds a "right" to a jackshaft"
I would think there has to be a patent number on it...or something?
Anyway, i disagree.
These things are up for grabs as part of engineering concepts.

Right. A Patent is a (temp) Monopoly right, for sales. The idea is, the monopoly is granted for those who go public with the idea - rather than keep it secret.


...of course, contrary to public disclosure - and the intention of the program, the latest trend has been in writing patents in obscure terminology so that no one knows what actually got patented. (Lawyers - meh) -I have patents, of my inventions, that I can not follow. (crazy)

As usual my problems are simple and complex from people trying to protect ideas that should be thrown in the Trash.
I have a IDIOT trying to tell me a jack shaft hold a patent....Beer out my nose! LOL
BUT, i thought i would check here with Borg of thought..even if it is some how it is patent, I think i am in the clear to make it for myself only a better version.

yes you can make it for yourself


Usually when people or buisnesses say they have a patent on something, they are refering to coverage of a small nuance in the design. This is espescially true for developed mechanical fields such as aircraft.

The process by which they are made can be.

Or if a radical new design feature like if you invented a wheel that could dynamically change size.

Easiest thing to do is just go to USPTO and do a patent search for jack shaft.

If I understand it correctly, if you actually do manage to make a better jack shaft with unique features, Your jack shaft might be sell able and patent able.

I see nothing unique, the one from factory shaft, is cantilevered (no bearing on one end) They all keep breaking. (ALL! after so many hours) like a 100 hrs , and its a 4000.00 dollar fix.
I say just add one more bearing to support the end .
Simple.
I am Getting a lot of static about "rights sold" .
Turns out -
Some one else had this same idea 10 years ago to fix the problem.
So the guy that came up with this idea then says he sold the "rights" back to the original factory.....
I do not understand the term at all....
There is nothing on the part showing a PAT. number.
I do not know why a factory would buy "rights to a part they make just slightly modified .
There is nothing special about the part other then it is made wrong and the company will not fix it.
They seem to like to sell parts.....make bigger shafts they break too.....!
A cantilever shaft has to be manufactured like a car live axle, not just hardened bar stock, or they shear under load.
hope this all makes sense

They could hold patents. ... and have expired in 1890.

If you are not selling the item - or selling plans to make the item - isn't it perfectly legal to make your own - even if it is patented?

I have made parts B4 for myself....How would anyone know? LOL
But i think its legal if you did not sell it afaik.
I just can not figure out the "rights" B.S. i think it is a scare tactic.
