Way, way more to the story that we are reading in that "news" article. If it did in fact go down as implied (but not really stated), and she hit the cyclist while she was texting, she should be prosecuted to the fullest extent of the law. The fact that she is not, however, and the manner in which the article is written, would lead one to believe that it quite possibly went down in a far different way than they would have us believe.
The article seems to say that while she was texting while driving, she was in fact not texting at the time of the collision. The article also fails to make it clear as to who hit whom, who had the right away, or anything like that. So (playing devil's advocate here), if the cylist did in fact hit her when she had the right of way, if she was not texting at the time, then to hell with him. He actually got off pretty easy. Funny how in motor vehicle / bicycle accidents how the benefit of the doubt always goes to the cyclist. Based purely on my own observations both as a motorist and an avid cyclist in my younger years, I would suggest that the vast majority of the time any such collision is entirel the cyclist's fault. Too many ride like absolute ass holes, ignoring all traffic laws (ironically, designed for their own safety) and taking ill-advised chances to get through traffic. I to could care less if motorists run over these twits. |

Whatever she was doing it certainly wasn't the right thing.
